Elle n\u00e9cessite \u00e9galement une r\u00e9vision des autres peines fond\u00e9es sur des concepts qui ne sont plus compatibles avec les normes internationales contemporaines relatives aux droits de l&rsquo;homme, au premier rang desquelles figurent les peines de travaux forc\u00e9s. \u00c0 cet \u00e9gard, la Commission appelle \u00e0 l&rsquo;abolition simultan\u00e9e de la peine de mort et des peines de travaux forc\u00e9s dans la l\u00e9gislation libanaise, et \u00e0 leur remplacement par des peines privatives de libert\u00e9 r\u00e9pondant aux exigences de la justice et de la responsabilit\u00e9, tout en respectant la dignit\u00e9 humaine et la finalit\u00e9 r\u00e9habilitative de la peine.<\/p>\n<p data-start=\"2659\" data-end=\"3113\" data-is-last-node=\"\" data-is-only-node=\"\">La Commission consid\u00e8re que le droit \u00e0 la vie et le droit \u00e0 la dignit\u00e9 humaine constituent deux piliers fondamentaux de tout syst\u00e8me moderne de justice p\u00e9nale. Un \u00c9tat qui renonce \u00e0 \u00f4ter la vie au nom de la loi ne devrait pas non plus maintenir dans son syst\u00e8me p\u00e9nal des peines fond\u00e9es sur le travail forc\u00e9 ou sur des concepts punitifs d\u00e9pass\u00e9s par les l\u00e9gislations modernes et les d\u00e9veloppements successifs du droit international des droits de l&rsquo;homme.<\/p>\n<p data-start=\"2493\" data-end=\"2989\">Cette r\u00e9forme rev\u00eat une importance particuli\u00e8re au Liban, qui n\u2019a proc\u00e9d\u00e9 \u00e0 aucune ex\u00e9cution depuis le 17 janvier 2004. Le Liban est \u00e9galement partie \u00e0 la Convention des Nations Unies contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants et s\u2019est engag\u00e9, en vertu du Pacte international relatif aux droits civils et politiques, \u00e0 garantir que toute personne priv\u00e9e de libert\u00e9 soit trait\u00e9e avec humanit\u00e9 et dans le respect de la dignit\u00e9 inh\u00e9rente \u00e0 la personne humaine.<\/p>\n<p data-start=\"2991\" data-end=\"3942\">Dans ce contexte, la Commission consid\u00e8re que la proposition d\u2019abolir la peine de mort constitue une occasion historique non seulement de mettre d\u00e9finitivement fin \u00e0 cette peine au Liban, mais \u00e9galement de lancer une r\u00e9vision globale de la politique p\u00e9nale afin d\u2019assurer sa pleine conformit\u00e9 avec la Constitution libanaise, les obligations internationales du Liban et les principes contemporains des droits de l\u2019homme. Depuis le 17 janvier 2004, les autorit\u00e9s libanaises n\u2019ont proc\u00e9d\u00e9 \u00e0 aucune ex\u00e9cution, ce qui place de facto le Liban parmi les \u00c9tats appliquant un moratoire effectif sur la peine de mort. Toutefois, le maintien de cette peine dans la l\u00e9gislation libanaise continue de faire peser sur des dizaines de personnes la menace d\u2019une sanction irr\u00e9versible et d\u00e9finitive. Selon les donn\u00e9es officielles publi\u00e9es par la Direction des prisons du minist\u00e8re de la Justice, 85 personnes \u00e9taient condamn\u00e9es \u00e0 mort \u00e0 la fin du mois de janvier 2026.<\/p>\n<p data-start=\"3944\" data-end=\"4529\">La Commission estime que le maintien de la peine de mort dans l\u2019arsenal l\u00e9gislatif libanais est incompatible avec le droit \u00e0 la vie, qui constitue le fondement de l\u2019ensemble des droits et libert\u00e9s. Il est \u00e9galement contraire \u00e0 l\u2019interdiction absolue de la torture et des autres peines ou traitements cruels, inhumains ou d\u00e9gradants. En outre, les exp\u00e9riences internationales et les \u00e9tudes comparatives n\u2019ont pas d\u00e9montr\u00e9 l\u2019existence d\u2019un lien direct entre l\u2019application de la peine de mort et une dissuasion plus efficace de la criminalit\u00e9 par rapport aux peines privatives de libert\u00e9.<\/p>\n<p data-start=\"4531\" data-end=\"5052\" data-is-last-node=\"\" data-is-only-node=\"\">La Commission souligne \u00e9galement que la tendance mondiale \u00e0 l\u2019abolition de la peine de mort est d\u00e9sormais solidement \u00e9tablie. La majorit\u00e9 des \u00c9tats dans le monde ont aboli cette peine, soit en droit, soit dans la pratique. Le Liban a par ailleurs vot\u00e9 \u00e0 plusieurs reprises en faveur des r\u00e9solutions de l\u2019Assembl\u00e9e g\u00e9n\u00e9rale des Nations Unies appelant \u00e0 un moratoire sur l\u2019application de la peine de mort, ce qui refl\u00e8te une volont\u00e9 politique croissante de passer d\u2019un moratoire de facto \u00e0 une abolition juridique compl\u00e8te.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"z-0 flex min-h-[46px] justify-start\">\n<p data-start=\"3244\" data-end=\"3642\">La Commission prend acte avec satisfaction de la d\u00e9cision de la Commission de l\u2019administration et de la justice d\u2019approuver le principe de l\u2019abolition totale de la peine de mort et de son remplacement automatique pour l\u2019ensemble des personnes condamn\u00e9es \u00e0 cette peine, garantissant ainsi que les personnes actuellement condamn\u00e9es \u00e0 mort b\u00e9n\u00e9ficieront des effets de la loi d\u00e8s son entr\u00e9e en vigueur.<\/p>\n<p data-start=\"3644\" data-end=\"4494\">La Commission consid\u00e8re que la commutation automatique et r\u00e9troactive de toutes les condamnations \u00e0 mort est conforme \u00e0 la philosophie des droits de l\u2019homme qui sous-tend l\u2019abolition. Une peine ne peut \u00eatre consid\u00e9r\u00e9e comme contraire \u00e0 la dignit\u00e9 humaine tout en continuant \u00e0 produire ses effets \u00e0 l\u2019\u00e9gard des personnes qui en ont d\u00e9j\u00e0 fait l\u2019objet. La Commission se f\u00e9licite \u00e9galement du fait que la Commission de l\u2019administration et de la justice ait renonc\u00e9 \u00e0 subordonner le b\u00e9n\u00e9fice de l\u2019abolition \u00e0 la position des proches des victimes, d\u00e8s lors que la d\u00e9termination, la modification et l\u2019ex\u00e9cution des peines rel\u00e8vent de la comp\u00e9tence exclusive de l\u2019\u00c9tat et des autorit\u00e9s judiciaires. Subordonner ces questions \u00e0 des positions individuelles pourrait porter atteinte au principe d\u2019\u00e9galit\u00e9 devant la loi ainsi qu\u2019\u00e0 l\u2019unit\u00e9 de la politique p\u00e9nale.<\/p>\n<p data-start=\"4496\" data-end=\"4808\">Par ailleurs, la Commission estime que l\u2019adoption des travaux forc\u00e9s \u00e0 perp\u00e9tuit\u00e9 comme peine de substitution \u00e0 la peine de mort soul\u00e8ve un certain nombre de pr\u00e9occupations juridiques et relatives aux droits de l\u2019homme qui m\u00e9ritent d\u2019\u00eatre examin\u00e9es lors du d\u00e9bat du projet de loi en s\u00e9ance pl\u00e9ni\u00e8re du Parlement.<\/p>\n<p data-start=\"4810\" data-end=\"5158\">Historiquement, les travaux forc\u00e9s reposent sur la notion de travail forc\u00e9 comme \u00e9l\u00e9ment constitutif de la peine. Cette conception n\u2019est plus compatible avec l\u2019\u00e9volution du droit international des droits de l\u2019homme ni avec les principes modernes de la justice p\u00e9nale, qui placent la dignit\u00e9 humaine et la r\u00e9insertion au c\u0153ur de la politique p\u00e9nale.<\/p>\n<p data-start=\"5160\" data-end=\"5526\">Le Liban a \u00e9galement ratifi\u00e9 la Convention des Nations Unies contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants, adopt\u00e9e \u00e0 New York le 10 d\u00e9cembre 1984. Cet engagement devrait progressivement se refl\u00e9ter dans la l\u00e9gislation p\u00e9nale nationale par la r\u00e9vision des peines comportant des \u00e9l\u00e9ments de travail forc\u00e9 ou de contrainte physique.<\/p>\n<p data-start=\"5528\" data-end=\"5859\">Dans cette perspective, la Commission consid\u00e8re que l\u2019abolition de la peine de mort devrait s\u2019accompagner d\u2019une r\u00e9forme l\u00e9gislative plus large visant \u00e0 supprimer les peines de travaux forc\u00e9s du Code p\u00e9nal libanais et \u00e0 les remplacer par des peines d\u2019emprisonnement de m\u00eame dur\u00e9e, sans aucun \u00e9l\u00e9ment de travail forc\u00e9 ou obligatoire.<\/p>\n<p data-start=\"5861\" data-end=\"6247\">Une telle r\u00e9forme est conforme aux principes contemporains des droits de l\u2019homme, qui rejettent toute forme de travail impos\u00e9 sous la contrainte, et s\u2019inscrit dans l\u2019\u00e9volution observ\u00e9e dans de nombreux syst\u00e8mes juridiques compar\u00e9s ayant abandonn\u00e9 la notion de travaux forc\u00e9s, consid\u00e9r\u00e9e comme un h\u00e9ritage p\u00e9nal incompatible avec la dignit\u00e9 humaine et les objectifs modernes de la peine.<\/p>\n<p data-start=\"6249\" data-end=\"6670\" data-is-last-node=\"\" data-is-only-node=\"\">Cette modification renforcerait \u00e9galement la conformit\u00e9 du Liban avec l\u2019article 10 du Pacte international relatif aux droits civils et politiques, qui pr\u00e9voit que \u00ab toute personne priv\u00e9e de libert\u00e9 doit \u00eatre trait\u00e9e avec humanit\u00e9 et dans le respect de la dignit\u00e9 inh\u00e9rente \u00e0 la personne humaine \u00bb, et que le but essentiel du r\u00e9gime p\u00e9nitentiaire doit \u00eatre l\u2019amendement et la r\u00e9adaptation sociale des personnes condamn\u00e9es.<\/p>\n<p data-start=\"1768\" data-end=\"2121\">Dans cette perspective, la Commission estime que le remplacement des peines de travaux forc\u00e9s par des peines d\u2019emprisonnement de m\u00eame dur\u00e9e permettrait de r\u00e9aliser l\u2019\u00e9quilibre n\u00e9cessaire entre les exigences de justice et de responsabilit\u00e9, d\u2019une part, et le respect de la dignit\u00e9 humaine ainsi que des obligations internationales du Liban, d\u2019autre part.<\/p>\n<p data-start=\"2123\" data-end=\"2691\">De mani\u00e8re plus g\u00e9n\u00e9rale, la Commission consid\u00e8re que cette proposition de loi constitue une \u00e9tape historique vers l\u2019humanisation du syst\u00e8me p\u00e9nal libanais et vers la consolidation d\u2019une conception de la justice fond\u00e9e sur le respect de la personne humaine et de ses droits fondamentaux.
