Cette recommandation \u00e9tablit un ensemble de normes minimales, dont certaines figurent d\u00e9j\u00e0 dans diff\u00e9rents instruments, telles que le recours \u00e0 la d\u00e9tention provisoire en dernier ressort et l\u2019introduction de r\u00e9examens p\u00e9riodiques lorsque son utilisation est justifi\u00e9e, l\u2019\u00e9tablissement de normes minimales concernant la taille des cellules, le temps pass\u00e9 \u00e0 l\u2019ext\u00e9rieur, la nutrition et les conditions de soins de sant\u00e9, ainsi que des initiatives visant la r\u00e9insertion et la r\u00e9habilitation sociale.<\/p>\n<p data-start=\"905\" data-end=\"1699\">La recommandation introduit \u00e9galement des mesures sp\u00e9cifiques pour faire face \u00e0 la question de la radicalisation en prison, en encourageant les \u00c9tats membres \u00e0 proc\u00e9der \u00e0 une \u00e9valuation initiale des risques afin de d\u00e9terminer le r\u00e9gime appropri\u00e9 applicable aux d\u00e9tenus soup\u00e7onn\u00e9s ou condamn\u00e9s pour des infractions terroristes ou d\u2019extr\u00e9misme violent. Par exemple, les autorit\u00e9s pourraient d\u00e9cider d\u2019emp\u00eacher ces personnes d\u2019avoir un contact direct avec des d\u00e9tenus particuli\u00e8rement vuln\u00e9rables. D\u2019autres mesures sp\u00e9cifiques sont \u00e9galement propos\u00e9es pour les femmes et les filles, les personnes LGBTIQ, les ressortissants \u00e9trangers, les personnes en situation de handicap et d\u2019autres d\u00e9tenus vuln\u00e9rables, notamment en garantissant un acc\u00e8s ad\u00e9quat \u00e0 des services professionnels d\u2019interpr\u00e9tation.<\/p>\n<p data-start=\"1701\" data-end=\"2453\" data-is-last-node=\"\" data-is-only-node=\"\">La <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Commission europ\u00e9enne<\/span><\/span> a \u00e9galement publi\u00e9 aujourd\u2019hui un aper\u00e7u statistique des divergences de conditions entre les \u00c9tats membres. Les r\u00e9sultats montrent, par exemple, que huit \u00c9tats membres pr\u00e9sentent une densit\u00e9 carc\u00e9rale sup\u00e9rieure \u00e0 100 d\u00e9tenus pour 100 places, tandis que cinq connaissent une surpopulation avec des taux d\u00e9passant 105 d\u00e9tenus pour 100 places. L\u2019aper\u00e7u met \u00e9galement en \u00e9vidence une grande diversit\u00e9 en mati\u00e8re de d\u00e9tention provisoire au sein de l\u2019Union europ\u00e9enne. En 2020, la dur\u00e9e moyenne variait de 2,4 mois \u00e0 12,9 mois. En outre, les r\u00e9sultats montrent que le co\u00fbt de la d\u00e9tention provisoire varie consid\u00e9rablement entre les \u00c9tats membres, allant de 6,50 euros par jour et par d\u00e9tenu \u00e0 332,63 euros par jour.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/section>\n<\/div>\n<p data-start=\"2411\" data-end=\"2706\"><strong data-start=\"2411\" data-end=\"2432\">Prochaines \u00e9tapes<\/strong><br data-start=\"2432\" data-end=\"2435\" \/>La recommandation entre en vigueur \u00e0 compter d\u2019aujourd\u2019hui et sera pr\u00e9sent\u00e9e aux ministres lors de la r\u00e9union du Conseil \u00ab Justice \u00bb. Les \u00c9tats membres sont invit\u00e9s \u00e0 prendre les mesures n\u00e9cessaires au niveau national pour aligner leurs pratiques sur ces recommandations.<\/p>\n<p data-start=\"2708\" data-end=\"3102\"><strong data-start=\"2708\" data-end=\"2720\">Contexte<\/strong><br data-start=\"2720\" data-end=\"2723\" \/>Lors du Conseil \u00ab Justice et affaires int\u00e9rieures \u00bb d\u2019octobre 2021, o\u00f9 la question de la d\u00e9tention figurait \u00e0 l\u2019ordre du jour, les ministres ont demand\u00e9 \u00e0 la Commission d\u2019opter pour des recommandations ou des lignes directrices visant \u00e0 am\u00e9liorer les conditions de d\u00e9tention et \u00e0 renforcer le recours \u00e0 des mesures alternatives, plut\u00f4t qu\u2019\u00e0 une l\u00e9gislation de l\u2019Union europ\u00e9enne.<\/p>\n<p data-start=\"3104\" data-end=\"3586\">La recommandation d\u2019aujourd\u2019hui compl\u00e8te les droits proc\u00e9duraux \u00e9tablis par les directives relatives au droit \u00e0 l\u2019interpr\u00e9tation et \u00e0 la traduction, au droit \u00e0 l\u2019information, au droit d\u2019acc\u00e8s \u00e0 un avocat, \u00e0 la pr\u00e9somption d\u2019innocence, aux garanties proc\u00e9durales pour les enfants et \u00e0 l\u2019aide juridictionnelle. Elle compl\u00e8te \u00e9galement la recommandation de la <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Commission europ\u00e9enne<\/span><\/span> du 27 novembre 2013 relative aux garanties proc\u00e9durales pour les personnes vuln\u00e9rables.<\/p>\n<p data-start=\"3588\" data-end=\"3842\">Bien que tous les \u00c9tats membres soient tenus de respecter la <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Convention europ\u00e9enne des droits de l\u2019homme<\/span><\/span>, il existe en pratique des diff\u00e9rences importantes en mati\u00e8re de d\u00e9tention provisoire, et les conditions mat\u00e9rielles de d\u00e9tention varient consid\u00e9rablement.<\/p>\n<p data-start=\"3844\" data-end=\"4207\">Les organes de contr\u00f4le des prisons dans l\u2019ensemble de l\u2019Union europ\u00e9enne signalent des pr\u00e9occupations. En 2021, 81 constats de violations de l\u2019article 3 de la Convention (traitements inhumains ou d\u00e9gradants) ont \u00e9t\u00e9 relev\u00e9s dans 14 \u00c9tats membres, et 46 cas de violations de l\u2019article 5 (droit \u00e0 la libert\u00e9 et \u00e0 la s\u00fbret\u00e9) ont \u00e9t\u00e9 constat\u00e9s dans 12 \u00c9tats membres.<\/p>\n<p data-start=\"4209\" data-end=\"4592\">Ces diff\u00e9rences entre les \u00c9tats membres ont un impact sur la confiance mutuelle et la coop\u00e9ration judiciaire en mati\u00e8re p\u00e9nale, notamment dans le cadre de la reconnaissance mutuelle et du fonctionnement du mandat d\u2019arr\u00eat europ\u00e9en.
