{"id":6775,"date":"2019-07-16T10:20:37","date_gmt":"2019-07-16T07:20:37","guid":{"rendered":"https:\/\/nhrclb.org\/archives\/6775"},"modified":"2026-04-24T10:41:55","modified_gmt":"2026-04-24T07:41:55","slug":"%d9%85%d9%86-%d9%87%d9%8a-%d8%a7%d9%84%d9%87%d9%8a%d8%a6%d8%a9-%d8%a7%d9%84%d9%88%d8%b7%d9%86%d9%8a%d8%a9-%d9%84%d8%ad%d9%82%d9%88%d9%82-%d8%a7%d9%84%d8%a5%d9%86%d8%b3%d8%a7%d9%86-%d8%9f","status":"publish","type":"post","link":"https:\/\/nhrclb.org\/fr\/archives\/6775","title":{"rendered":"Qu\u2019est-ce que la Commission nationale des droits de l\u2019homme incluant le Comit\u00e9 pour la pr\u00e9vention de la torture ?"},"content":{"rendered":"<p data-start=\"2142\" data-end=\"2633\">Conform\u00e9ment aux Principes de Paris r\u00e9gissant la cr\u00e9ation et le fonctionnement des institutions nationales des droits de l\u2019homme, et \u00e0 la suite de nombreuses recommandations adress\u00e9es \u00e0 l\u2019\u00c9tat libanais par le Conseil des droits de l\u2019homme des Nations Unies et les organes conventionnels internationaux, la loi n\u00b0 62 du 27 octobre 2016, telle que modifi\u00e9e, a \u00e9t\u00e9 adopt\u00e9e, portant cr\u00e9ation de la Commission nationale des droits de l\u2019homme incluant le Comit\u00e9 pour la pr\u00e9vention de la torture.<\/p>\n<p data-start=\"2635\" data-end=\"3097\">Les institutions nationales des droits de l\u2019homme sont financ\u00e9es par l\u2019\u00c9tat mais demeurent ind\u00e9pendantes de celui-ci. Elles ne sont pas des organisations non gouvernementales, mais agissent comme un \u00ab pont \u00bb entre la soci\u00e9t\u00e9 civile et les pouvoirs publics. Elles sont connues sous diff\u00e9rentes appellations selon les pays, telles que commissions, conseils, m\u00e9diateurs, d\u00e9fenseurs publics ou autres institutions charg\u00e9es de la protection des droits des citoyens.<\/p>\n<p data-start=\"3099\" data-end=\"3544\">Le Liban a adh\u00e9r\u00e9 au Protocole facultatif \u00e0 la Convention contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants par la loi n\u00b0 12 du 5 septembre 2008. En application de l\u2019article 17 de ce protocole, l\u2019\u00c9tat s\u2019est engag\u00e9 \u00e0 mettre en place un m\u00e9canisme national ind\u00e9pendant de pr\u00e9vention de la torture par la cr\u00e9ation de la Commission nationale des droits de l\u2019homme incluant le Comit\u00e9 pour la pr\u00e9vention de la torture.<\/p>\n<p data-start=\"3546\" data-end=\"3656\">La Commission a \u00e9t\u00e9 constitu\u00e9e par le d\u00e9cret n\u00b0 3267 du 19 juin 2018 et le d\u00e9cret n\u00b0 5147 du 5 juillet 2019.<\/p>\n<p data-start=\"3658\" data-end=\"3841\">Conform\u00e9ment \u00e0 l\u2019article 5 de la loi n\u00b0 62\/2016, les membres de la Commission ont pr\u00eat\u00e9 le serment suivant devant le Pr\u00e9sident de la R\u00e9publique les 16 juillet 2019 et 14 ao\u00fbt 2019 :<\/p>\n<p data-start=\"3843\" data-end=\"4159\">\u00ab Je jure par Dieu Tout-Puissant d\u2019exercer mes fonctions au sein de la Commission nationale des droits de l\u2019homme avec honn\u00eatet\u00e9, loyaut\u00e9 et ind\u00e9pendance, et d\u2019agir en toute circonstance de mani\u00e8re \u00e0 inspirer confiance et \u00e0 pr\u00e9server l\u2019\u00c9tat de droit ainsi que la protection et la promotion des droits de l\u2019homme. \u00bb<\/p>\n<p data-start=\"4161\" data-end=\"4428\" data-is-last-node=\"\" data-is-only-node=\"\">En application de l\u2019article 6 et conform\u00e9ment aux dispositions du chapitre III de la loi n\u00b0 62\/2016 (articles 15 \u00e0 20 inclus), la Commission a, le 12 novembre 2019, \u00e9lu son pr\u00e9sident et les membres de son bureau et r\u00e9parti les fonctions entre ses membres comme suit :<\/p>\n<p data-start=\"4551\" data-end=\"5328\">Dr Fadi Gerges \u2013 Pr\u00e9sident de la Commission<br data-start=\"4594\" data-end=\"4597\" \/>Juge Khalil Abou Rajili \u2013 Pr\u00e9sident du Comit\u00e9 pour la pr\u00e9vention de la torture et Vice-pr\u00e9sident de la Commission<br data-start=\"4710\" data-end=\"4713\" \/>Me Dr Rana Al-Jamal \u2013 Secr\u00e9taire<br data-start=\"4745\" data-end=\"4748\" \/>M. Ali Youssef \u2013 Tr\u00e9sorier et Commissaire aux plaintes<br data-start=\"4802\" data-end=\"4805\" \/>M. Bassam Al Kantar \u2013 Commissaire aux relations internationales et Commissaire aux m\u00e9dias et aux technologies de l\u2019information<br data-start=\"4931\" data-end=\"4934\" \/>Pr Fadl Daher \u2013 Commissaire aux \u00e9tudes et au suivi, et Commissaire \u00e0 l\u2019\u00e9ducation et au d\u00e9veloppement<br data-start=\"5034\" data-end=\"5037\" \/>Dr Josiane Madi Skaf \u2013 Membre du Comit\u00e9 pour la pr\u00e9vention de la torture<br data-start=\"5109\" data-end=\"5112\" \/>Me Raymond Madlej \u2013 Membre du Comit\u00e9 pour la pr\u00e9vention de la torture<br data-start=\"5181\" data-end=\"5184\" \/>Mme Rida Ramez Azar \u2013 Membre du Comit\u00e9 pour la pr\u00e9vention de la torture<br data-start=\"5255\" data-end=\"5258\" \/>Dr Bilal Sablouh \u2013 Membre du Comit\u00e9 pour la pr\u00e9vention de la torture<\/p>\n<p data-start=\"5330\" data-end=\"5391\"><strong data-start=\"5330\" data-end=\"5389\">Mandat de la Commission nationale des droits de l\u2019homme<\/strong><\/p>\n<p data-start=\"5393\" data-end=\"5492\">La loi n\u00b0 62\/2016 d\u00e9finit le mandat de la Commission nationale des droits de l\u2019homme comme suit :<\/p>\n<p data-start=\"5494\" data-end=\"6010\">La Commission \u0153uvre \u00e0 la protection et \u00e0 la promotion des droits de l\u2019homme au Liban conform\u00e9ment aux normes \u00e9nonc\u00e9es dans la Constitution libanaise, la D\u00e9claration universelle des droits de l\u2019homme, les conventions et trait\u00e9s internationaux pertinents, ainsi que les lois libanaises conformes \u00e0 ces normes, en plus des missions sp\u00e9cifiques pr\u00e9vues par la loi. Elle peut, \u00e0 cet effet, communiquer de mani\u00e8re ind\u00e9pendante avec les instances nationales et internationales comp\u00e9tentes en mati\u00e8re de droits de l\u2019homme.<\/p>\n<p data-start=\"6012\" data-end=\"6087\">Plus particuli\u00e8rement, la Commission est charg\u00e9e des missions suivantes :<\/p>\n<ol data-start=\"6089\" data-end=\"6955\">\n<li data-section-id=\"1dsg7sc\" data-start=\"6089\" data-end=\"6238\">Surveiller le respect par le Liban des droits de l\u2019homme et du droit international humanitaire, et publier des rapports sp\u00e9ciaux et p\u00e9riodiques.<\/li>\n<li data-section-id=\"10s5b2q\" data-start=\"6239\" data-end=\"6319\">Contribuer de mani\u00e8re ind\u00e9pendante aux rapports soumis par l\u2019\u00c9tat libanais.<\/li>\n<li data-section-id=\"dleyr9\" data-start=\"6320\" data-end=\"6628\">\u00c9mettre des avis sur les questions qui lui sont soumises par les autorit\u00e9s comp\u00e9tentes ou de sa propre initiative concernant le respect des normes relatives aux droits de l\u2019homme.<br data-start=\"6502\" data-end=\"6505\" \/>Elle peut \u00e9galement se prononcer sur les l\u00e9gislations, d\u00e9crets, d\u00e9cisions, projets de loi et politiques en la mati\u00e8re.<\/li>\n<li data-section-id=\"qr100u\" data-start=\"6629\" data-end=\"6806\">Recevoir les plaintes et signalements relatifs aux violations des droits de l\u2019homme et contribuer \u00e0 leur traitement par la n\u00e9gociation, la m\u00e9diation ou l\u2019action judiciaire.<\/li>\n<li data-section-id=\"1s3vusj\" data-start=\"6807\" data-end=\"6955\">Promouvoir la culture des droits de l\u2019homme et encourager la mise en \u0153uvre et le d\u00e9veloppement de programmes d\u2019\u00e9ducation aux droits de l\u2019homme.<\/li>\n<\/ol>\n<p data-start=\"6957\" data-end=\"7012\"><strong data-start=\"6957\" data-end=\"7010\">Mandat du Comit\u00e9 pour la pr\u00e9vention de la torture<\/strong><\/p>\n<p data-start=\"7014\" data-end=\"7107\">La loi n\u00b0 62\/2016 d\u00e9finit le mandat du Comit\u00e9 pour la pr\u00e9vention de la torture comme suit :<\/p>\n<p data-start=\"7109\" data-end=\"7409\">Le Comit\u00e9 agit au sein de la Commission pour prot\u00e9ger les droits des personnes priv\u00e9es de libert\u00e9, conform\u00e9ment aux dispositions de la loi et aux engagements du Liban au titre du Protocole facultatif \u00e0 la Convention contre la torture et autres peines ou traitements cruels, inhumains ou d\u00e9gradants.<\/p>\n<p data-start=\"7411\" data-end=\"7664\">Au sens du Protocole facultatif, le Comit\u00e9 constitue le m\u00e9canisme national de pr\u00e9vention, charg\u00e9 de prot\u00e9ger les droits des personnes d\u00e9tenues, et dispose d\u2019une personnalit\u00e9 juridique ind\u00e9pendante pour tout ce qui concerne la pr\u00e9vention de la torture.<\/p>\n<p data-start=\"7666\" data-end=\"8094\">Le Comit\u00e9, ou les personnes qu\u2019il mandate parmi ses membres, son personnel ou ses experts contractuels, dispose d\u2019un pouvoir illimit\u00e9 d\u2019acc\u00e8s et de visite \u00e0 tous les lieux de privation de libert\u00e9 au Liban, sans aucune exception, afin de prot\u00e9ger les personnes contre la torture, les mauvais traitements ou la d\u00e9tention arbitraire, et de coop\u00e9rer avec les autorit\u00e9s comp\u00e9tentes pour am\u00e9liorer les lois et r\u00e8glements pertinents.<\/p>\n<p data-start=\"8096\" data-end=\"8133\">Le Comit\u00e9 ou ses d\u00e9l\u00e9gu\u00e9s peuvent :<\/p>\n<ol data-start=\"8135\" data-end=\"8792\">\n<li data-section-id=\"3advaf\" data-start=\"8135\" data-end=\"8283\">Effectuer des visites r\u00e9guli\u00e8res ou inopin\u00e9es \u00e0 tout moment dans les lieux de privation de libert\u00e9 sans pr\u00e9avis et sans autorisation pr\u00e9alable.<\/li>\n<li data-section-id=\"mzjds7\" data-start=\"8284\" data-end=\"8465\">Mener des entretiens individuels ou collectifs avec toute personne priv\u00e9e de libert\u00e9, en toute confidentialit\u00e9 et sans surveillance, avec recours \u00e0 un interpr\u00e8te si n\u00e9cessaire.<\/li>\n<li data-section-id=\"10lqvld\" data-start=\"8466\" data-end=\"8701\">Rencontrer toute autre personne susceptible de fournir des informations pertinentes et exercer un acc\u00e8s illimit\u00e9 aux informations de mani\u00e8re confidentielle. Le Comit\u00e9 ne publie aucune information sans le consentement de sa source.<\/li>\n<li data-section-id=\"1fkgro7\" data-start=\"8702\" data-end=\"8792\">Recevoir des plaintes ou des demandes d\u2019entretien, ou proc\u00e9der \u00e0 tout examen m\u00e9dical.<\/li>\n<\/ol>\n<p data-start=\"8794\" data-end=\"9083\" data-is-last-node=\"\" data-is-only-node=\"\">L\u2019article 27(b) de la loi n\u00b0 62\/2016 conf\u00e8re au Comit\u00e9 le droit de communiquer directement avec le Sous-comit\u00e9 des Nations Unies pour la pr\u00e9vention de la torture, de lui transmettre des informations lorsque n\u00e9cessaire, et de se r\u00e9unir avec lui p\u00e9riodiquement ou chaque fois que n\u00e9cessaire.<\/p>\n<p data-start=\"3483\" data-end=\"3503\"><strong data-start=\"3483\" data-end=\"3501\">Rapport annuel<\/strong><\/p>\n<p data-start=\"3505\" data-end=\"4117\">La Commission et le Comit\u00e9, chacun dans le cadre de ses comp\u00e9tences, \u00e9laborent un rapport annuel unifi\u00e9 comprenant leur programme annuel, leurs r\u00e9alisations et les difficult\u00e9s rencontr\u00e9es. La Commission soumet ce rapport consolid\u00e9 \u00e0 la Pr\u00e9sidence de la R\u00e9publique, \u00e0 la Pr\u00e9sidence du Parlement, \u00e0 la Pr\u00e9sidence du Conseil des ministres et au Pr\u00e9sident du Conseil sup\u00e9rieur de la magistrature. Le rapport est publi\u00e9 au Journal officiel, et le Parlement peut en d\u00e9battre. Il veille \u00e0 ne pas inclure de donn\u00e9es personnelles ou d\u00e9taill\u00e9es permettant d\u2019identifier les victimes ou les t\u00e9moins sans leur consentement.<\/p>\n<p data-start=\"4119\" data-end=\"4148\"><strong data-start=\"4119\" data-end=\"4146\">Commissions permanentes<\/strong><\/p>\n<p data-start=\"4150\" data-end=\"4319\">Conform\u00e9ment \u00e0 l\u2019article 12 de la loi n\u00b0 62\/2016, la Commission nationale des droits de l\u2019homme a \u00e9tabli, par son r\u00e8glement int\u00e9rieur, quatre commissions permanentes :<\/p>\n<p data-start=\"4321\" data-end=\"4561\"><strong data-start=\"4321\" data-end=\"4370\">Commission du droit international humanitaire<\/strong><br data-start=\"4370\" data-end=\"4373\" \/>Cette commission veille au respect de toutes les conventions et protocoles du droit international humanitaire ainsi que des r\u00e8gles coutumi\u00e8res pertinentes auxquelles le Liban est partie.<\/p>\n<p data-start=\"4563\" data-end=\"4968\"><strong data-start=\"4563\" data-end=\"4648\">Commission des plaintes des enfants victimes de violations des droits de l\u2019enfant<\/strong><br data-start=\"4648\" data-end=\"4651\" \/>Cette commission constitue le m\u00e9canisme national de plainte pour les enfants victimes de violations de leurs droits. Elle se fonde sur le principe de l\u2019int\u00e9r\u00eat sup\u00e9rieur de l\u2019enfant, tient compte de ses droits et de ses opinions, et accorde \u00e0 celles-ci l\u2019importance requise en fonction de son \u00e2ge et de sa maturit\u00e9.<\/p>\n<p data-start=\"4970\" data-end=\"5212\"><strong data-start=\"4970\" data-end=\"5040\">Commission pour la protection des droits des personnes handicap\u00e9es<\/strong><br data-start=\"5040\" data-end=\"5043\" \/>Sans pr\u00e9judice des comp\u00e9tences des autorit\u00e9s concern\u00e9es, cette commission constitue le m\u00e9canisme national charg\u00e9 de la protection des droits des personnes handicap\u00e9es.<\/p>\n<p data-start=\"5214\" data-end=\"5458\"><strong data-start=\"5214\" data-end=\"5268\">Commission de lutte contre la traite des personnes<\/strong><br data-start=\"5268\" data-end=\"5271\" \/>Sans pr\u00e9judice des comp\u00e9tences des autorit\u00e9s comp\u00e9tentes, cette commission est charg\u00e9e de lutter contre la traite des personnes et de garantir la protection des victimes et des t\u00e9moins.<\/p>\n<p data-start=\"5460\" data-end=\"5520\"><strong data-start=\"5460\" data-end=\"5518\">Accr\u00e9ditation au statut \u00ab A \u00bb aupr\u00e8s des Nations Unies<\/strong><\/p>\n<p data-start=\"5522\" data-end=\"5831\">Les Principes de Paris, reconnus au niveau international, d\u00e9finissent le r\u00f4le, la composition, le statut et les fonctions des institutions nationales des droits de l\u2019homme. \u00c9labor\u00e9s lors d\u2019un atelier international tenu \u00e0 Paris en 1991, ils ont \u00e9t\u00e9 adopt\u00e9s par l\u2019Assembl\u00e9e g\u00e9n\u00e9rale des Nations Unies en 1993.<\/p>\n<p data-start=\"5833\" data-end=\"6173\">La Commission nationale des droits de l\u2019homme, incluant le Comit\u00e9 pour la pr\u00e9vention de la torture, \u0153uvre \u00e0 la pr\u00e9paration de l\u2019ensemble des documents et rapports requis afin de solliciter une accr\u00e9ditation aupr\u00e8s des Nations Unies et d\u2019adh\u00e9rer \u00e0 l\u2019Alliance mondiale des institutions nationales des droits de l\u2019homme avec le statut \u00ab A \u00bb.<\/p>\n<p data-start=\"6175\" data-end=\"6237\"><strong data-start=\"6175\" data-end=\"6235\">Adh\u00e9sion aux organisations r\u00e9gionales et internationales<\/strong><\/p>\n<p data-start=\"6239\" data-end=\"6685\">La Commission nationale des droits de l\u2019homme, incluant le Comit\u00e9 pour la pr\u00e9vention de la torture, a entam\u00e9 la pr\u00e9paration des dossiers d\u2019adh\u00e9sion aux organisations et instances internationales et r\u00e9gionales, aux m\u00e9canismes r\u00e9gionaux et arabes des droits de l\u2019homme, ainsi qu\u2019aux institutions \u00e9conomiques et de d\u00e9veloppement et aux r\u00e9seaux et groupes r\u00e9gionaux et internationaux \u0153uvrant \u00e0 la protection et \u00e0 la promotion des droits de l\u2019homme.<\/p>\n<p data-start=\"6687\" data-end=\"6735\">Parmi les principales organisations figurent :<\/p>\n<ul data-start=\"6737\" data-end=\"7047\" data-is-last-node=\"\" data-is-only-node=\"\">\n<li data-section-id=\"zfc7j5\" data-start=\"6737\" data-end=\"6819\">L\u2019Alliance mondiale des institutions nationales des droits de l\u2019homme (GANHRI)<\/li>\n<li data-section-id=\"184x02k\" data-start=\"6820\" data-end=\"6903\">Le Forum Asie-Pacifique des institutions nationales des droits de l\u2019homme (APF)<\/li>\n<li data-section-id=\"1wnt8al\" data-start=\"6904\" data-end=\"6979\">Le R\u00e9seau francophone des institutions nationales des droits de l\u2019homme<\/li>\n<li data-section-id=\"1q3fmyr\" data-start=\"6980\" data-end=\"7047\" data-is-last-node=\"\">Le R\u00e9seau arabe des institutions nationales des droits de l\u2019homme<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Conform\u00e9ment aux Principes de Paris r\u00e9gissant la cr\u00e9ation et le fonctionnement des institutions nationales des droits de l\u2019homme, et \u00e0 la suite de nombreuses recommandations adress\u00e9es \u00e0 l\u2019\u00c9tat libanais par le Conseil des droits de l\u2019homme des Nations Unies et les organes conventionnels internationaux, la loi n\u00b0 62 du 27 octobre 2016, telle que modifi\u00e9e, [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":6776,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[163],"tags":[],"class_list":{"0":"post-6775","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-documents-de-reference"},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
