Ils s\u2019appuient sur diff\u00e9rentes pratiques \u00e9tatiques, sans proposer de solution universelle unique. Le Guide fournit des conseils pratiques sur les \u00e9l\u00e9ments essentiels que les \u00c9tats doivent prendre en compte lors de la cr\u00e9ation ou du renforcement de leur m\u00e9canisme national, et illustre ces conseils par des exemples concrets. Il est fond\u00e9 sur une \u00e9tude plus compl\u00e8te sur l\u2019engagement des \u00c9tats avec les m\u00e9canismes internationaux des droits de l\u2019homme (HR\/PUB\/16\/1\/Add.1), qui contient des informations plus d\u00e9taill\u00e9es sur ces pratiques.<\/p>\n<h3 data-section-id=\"1msktpk\" data-start=\"1080\" data-end=\"1181\">Engagements dans le cadre du 75e anniversaire de la D\u00e9claration universelle des droits de l\u2019homme<\/h3>\n<p data-start=\"1183\" data-end=\"1812\">L\u2019initiative \u00ab Human Rights 75 \u00bb, lanc\u00e9e en d\u00e9cembre 2022, poursuivait trois objectifs principaux : promouvoir l\u2019universalit\u00e9 et l\u2019indivisibilit\u00e9 des droits de l\u2019homme, se projeter vers l\u2019avenir, et renforcer l\u2019\u00e9cosyst\u00e8me des droits humains. Les \u00c9tats ont \u00e9t\u00e9 encourag\u00e9s \u00e0 formuler des engagements concrets visant \u00e0 am\u00e9liorer la jouissance des droits de l\u2019homme pour tous. Certains \u00c9tats ont pris des engagements relatifs \u00e0 la cr\u00e9ation et au renforcement de m\u00e9canismes nationaux. Le HCDH et d\u2019autres parties prenantes se sont engag\u00e9s \u00e0 accompagner les \u00c9tats pour concr\u00e9tiser ces engagements.<\/p>\n<h3 data-section-id=\"1cs5ucw\" data-start=\"1814\" data-end=\"1849\">R\u00e9seaux de m\u00e9canismes nationaux<\/h3>\n<p data-start=\"1851\" data-end=\"2097\">Les efforts visant \u00e0 favoriser le partage d\u2019exp\u00e9riences ont conduit \u00e0 plusieurs initiatives de mise en r\u00e9seau des points focaux nationaux des droits de l\u2019homme ou des m\u00e9canismes nationaux de mise en \u0153uvre, de pr\u00e9sentation de rapports et de suivi.<\/p>\n<p data-start=\"2099\" data-end=\"2985\">En 2023, un r\u00e9seau de points focaux des droits de l\u2019homme des pays lusophones a \u00e9t\u00e9 \u00e9tabli lors de la r\u00e9union ordinaire du Conseil des ministres de la Communaut\u00e9 des pays de langue portugaise \u00e0 S\u00e3o Tom\u00e9-et-Pr\u00edncipe. La premi\u00e8re r\u00e9union de ce r\u00e9seau s\u2019est tenue en juin 2024. En 2023 et 2024, des initiatives dans les Cara\u00efbes et dans le Pacifique ont conduit \u00e0 un accord visant \u00e0 envisager la cr\u00e9ation de r\u00e9seaux r\u00e9gionaux. Au niveau mondial, le r\u00e9seau international des m\u00e9canismes nationaux de mise en \u0153uvre, de pr\u00e9sentation de rapports et de suivi a \u00e9t\u00e9 officiellement lanc\u00e9 \u00e0 travers la \u00ab D\u00e9claration d\u2019Asunci\u00f3n \u00bb le 9 mai 2024, adopt\u00e9e lors d\u2019une r\u00e9union organis\u00e9e par le Paraguay, avec la participation de 83 repr\u00e9sentants \u00e9tatiques. La cr\u00e9ation de ce r\u00e9seau international r\u00e9sulte d\u2019un engagement conjoint du Maroc, du Paraguay et du Portugal.<\/p>\n<h3 data-section-id=\"15aop3p\" data-start=\"2987\" data-end=\"3023\">Cadre d\u2019orientation de Marrakech<\/h3>\n<p data-start=\"3025\" data-end=\"3590\">Dans la continuit\u00e9 des initiatives pr\u00e9c\u00e9dentes, le 10e Dialogue de Glion sur les droits de l\u2019homme, coorganis\u00e9 par le Royaume du Maroc et l\u2019Universal Rights Group \u00e0 Marrakech en octobre 2024, a conduit \u00e0 l\u2019adoption du <strong data-start=\"3243\" data-end=\"3316\">Cadre d\u2019orientation de Marrakech (Marrakech Guidance Framework &#8211; MGF)<\/strong>. Ce document constitue un outil de r\u00e9f\u00e9rence fond\u00e9 sur les bonnes pratiques internationales, destin\u00e9 \u00e0 aider les \u00c9tats \u00e0 \u00e9tablir et renforcer des m\u00e9canismes nationaux efficaces de mise en \u0153uvre, de pr\u00e9sentation de rapports et de suivi.<\/p>\n<h3 data-section-id=\"1x1rlq4\" data-start=\"3592\" data-end=\"3604\">Contexte<\/h3>\n<p data-start=\"3606\" data-end=\"4273\">L\u2019un des d\u00e9veloppements importants dans le domaine des droits de l\u2019homme est l\u2019\u00e9mergence des m\u00e9canismes nationaux de mise en \u0153uvre, de pr\u00e9sentation de rapports et de suivi (NMIRF). Il s\u2019agit de structures gouvernementales charg\u00e9es de coordonner la pr\u00e9paration des rapports destin\u00e9s aux m\u00e9canismes internationaux et r\u00e9gionaux des droits de l\u2019homme, et d\u2019interagir avec eux, notamment les organes conventionnels des Nations Unies, l\u2019Examen p\u00e9riodique universel (EPU) et les proc\u00e9dures sp\u00e9ciales. Ces m\u00e9canismes contribuent \u00e9galement \u00e0 combler le d\u00e9ficit de mise en \u0153uvre en assurant le suivi et l\u2019application des obligations et recommandations issues de ces m\u00e9canismes.<\/p>\n<p data-start=\"4275\" data-end=\"5039\">La cr\u00e9ation de NMIRF a \u00e9t\u00e9 une recommandation cl\u00e9 du rapport de la Haut-Commissaire des Nations Unies aux droits de l\u2019homme sur le renforcement des organes conventionnels en 2012 (A\/66\/860), ouvrant la voie \u00e0 la r\u00e9solution 68\/268 de l\u2019Assembl\u00e9e g\u00e9n\u00e9rale sur le renforcement du syst\u00e8me des organes conventionnels. Cette r\u00e9solution reconna\u00eet la n\u00e9cessit\u00e9 d\u2019am\u00e9liorer la coordination des rapports au niveau national et souligne l\u2019importance de l\u2019\u00e9change de bonnes pratiques. Dans le cadre de l\u2019examen de 2020 pr\u00e9vu par cette r\u00e9solution, il a \u00e9t\u00e9 soulign\u00e9 que la mise en \u0153uvre des recommandations b\u00e9n\u00e9ficierait d\u2019un suivi institutionnalis\u00e9 au niveau national, notamment \u00e0 travers la cr\u00e9ation ou le renforcement de tels m\u00e9canismes.<\/p>\n<p data-start=\"5041\" data-end=\"5570\">Le Conseil des droits de l\u2019homme a \u00e9galement adopt\u00e9 plusieurs r\u00e9solutions relatives \u00e0 ces m\u00e9canismes. La r\u00e9solution 30\/25 (2015) encourage leur mise en place et leur renforcement. La r\u00e9solution 36\/29 (2017) souligne leur contribution \u00e0 l\u2019Agenda 2030. La r\u00e9solution 42\/30 (2019) introduit la mise en \u0153uvre comme pilier central. La r\u00e9solution 51\/33 a notamment demand\u00e9 la cr\u00e9ation d\u2019un centre de connaissances (NMIRF Hub), lanc\u00e9 le 2 octobre 2025. En parall\u00e8le, un groupe d\u2019\u00c9tats amis a \u00e9t\u00e9 cr\u00e9\u00e9 en 2016 pour promouvoir cet agenda.<\/p>\n<h3 data-section-id=\"f7cx7s\" data-start=\"5572\" data-end=\"5592\">R\u00e9solution 60\/27<\/h3>\n<p data-start=\"5594\" data-end=\"5951\">Adopt\u00e9e le 9 octobre 2025, la r\u00e9solution 60\/27 demande au HCDH d\u2019organiser, en juin 2027, une table ronde d\u2019\u00e9change d\u2019exp\u00e9riences entre NMIRF. Elle demande \u00e9galement la pr\u00e9paration d\u2019un rapport sur les d\u00e9veloppements intervenus depuis la r\u00e9solution 51\/33, \u00e0 pr\u00e9senter au Conseil des droits de l\u2019homme en septembre 2027.<\/p>\n<h3 data-section-id=\"f7ykxb\" data-start=\"5953\" data-end=\"5973\">R\u00e9solution 51\/33<\/h3>\n<p data-start=\"5975\" data-end=\"6393\">En octobre 2022, sous l\u2019impulsion du Paraguay et du Br\u00e9sil, le Conseil des droits de l\u2019homme a adopt\u00e9 la r\u00e9solution 51\/33, demandant au HCDH d\u2019organiser des s\u00e9minaires en 2023 et 2024 \u00e0 Gen\u00e8ve afin de faciliter le partage d\u2019exp\u00e9riences entre \u00c9tats.
