Les donn\u00e9es qui les accompagnent, y compris les cartes, ne pr\u00e9sentent pas le niveau minimal de pr\u00e9cision et de clart\u00e9 n\u00e9cessaire pour permettre aux civils de prendre des mesures de protection appropri\u00e9es, et pourraient constituer un d\u00e9placement forc\u00e9 interdit.<\/p>\n<p data-start=\"3029\" data-end=\"3464\">La Commission a soulign\u00e9 que l\u2019\u00e9mission de tels avertissements ne dispense en aucun cas Isra\u00ebl de ses obligations juridiques au titre du droit international humanitaire, notamment l\u2019obligation de distinguer entre civils et objectifs militaires, l\u2019interdiction absolue de cibler les civils, ainsi que l\u2019obligation de prendre toutes les pr\u00e9cautions possibles pour \u00e9viter de porter atteinte aux civils et en r\u00e9duire les effets au minimum.<\/p>\n<p data-start=\"3466\" data-end=\"4040\">Conform\u00e9ment aux dispositions du droit international humanitaire, les parties \u00e0 un conflit sont tenues de prendre toutes les pr\u00e9cautions possibles, de mani\u00e8re pratique et effective, afin d\u2019\u00e9viter de causer des dommages aux civils ou, \u00e0 tout le moins, d\u2019en r\u00e9duire l\u2019ampleur au maximum lors de la conduite d\u2019op\u00e9rations offensives. Cette obligation inclut notamment la diffusion d\u2019avertissements pr\u00e9alables efficaces et pertinents \u00e0 la population civile dans les zones expos\u00e9es aux attaques, sauf si des circonstances op\u00e9rationnelles ou des n\u00e9cessit\u00e9s militaires s\u2019y opposent.<\/p>\n<p data-start=\"4042\" data-end=\"4984\">Les analyses men\u00e9es par les \u00e9quipes de suivi du Comit\u00e9 du droit international humanitaire au sein de la Commission nationale des droits de l\u2019homme au Liban montrent que les avertissements \u00e9mis par les forces isra\u00e9liennes ne se limitaient pas \u00e0 inclure des cartes trompeuses ou inexactes, mais pr\u00e9sentaient \u00e9galement des lacunes \u00e9videntes en termes de calendrier et de moyens de diffusion. Ces avertissements ont \u00e9t\u00e9 publi\u00e9s dans des d\u00e9lais extr\u00eamement courts ne permettant pas r\u00e9ellement aux civils de prendre des mesures de pr\u00e9caution efficaces, le d\u00e9lai n\u2019ayant, dans plusieurs cas, pas d\u00e9pass\u00e9 quinze minutes avant le d\u00e9but des frappes. Certains ont \u00e9galement \u00e9t\u00e9 diffus\u00e9s tard dans la nuit sur les r\u00e9seaux sociaux, dans des conditions o\u00f9 un grand nombre de civils \u00e9taient probablement endormis, hors ligne ou non inform\u00e9s par les m\u00e9dias, ce qui compromet leur efficacit\u00e9 et limite leur capacit\u00e9 \u00e0 atteindre l\u2019objectif juridique recherch\u00e9.<\/p>\n<p data-start=\"1767\" data-end=\"2539\">Au cours de la p\u00e9riode comprise entre le 3 et le 20 mars 2026, l\u2019arm\u00e9e isra\u00e9lienne a \u00e9mis une s\u00e9rie d\u2019ordres d\u2019\u00e9vacuation visant les habitants de villes et de villages entiers du sud du Liban, ainsi que des r\u00e9gions de la Bekaa et de la banlieue sud de Beyrouth. Parmi ces ordres, une directive publi\u00e9e le 5 mars enjoignait \u00e0 tous les habitants r\u00e9sidant au sud du fleuve Litani et dans la banlieue sud de Beyrouth de partir \u00ab imm\u00e9diatement \u00bb, sous pr\u00e9texte d\u2019assurer leur \u00ab s\u00e9curit\u00e9 \u00bb. Un autre ordre a suivi le 12 mars 2026, \u00e9largissant le champ de l\u2019\u00e9vacuation pour inclure au moins 17 villes et villages situ\u00e9s entre le fleuve Litani et le fleuve Zahrani, ce qui refl\u00e8te l\u2019ampleur croissante des mesures prises et leur caract\u00e8re collectif.<\/p>\n<p data-start=\"2541\" data-end=\"3107\">La Commission a soulign\u00e9 que l\u2019\u00e9mission d\u2019ordres d\u2019\u00e9vacuation couvrant des villes et des villages entiers dans le sud du Liban constitue, du point de vue du droit international humanitaire, un avertissement g\u00e9n\u00e9ral et abstrait d\u00e9pourvu de pr\u00e9cision et de sp\u00e9cificit\u00e9, et ne r\u00e9pond pas aux exigences d\u2019efficacit\u00e9 n\u00e9cessaires pour permettre aux civils de prendre des d\u00e9cisions \u00e9clair\u00e9es concernant leur s\u00e9curit\u00e9. Cela soul\u00e8ve de s\u00e9rieuses interrogations quant \u00e0 savoir si l\u2019objectif est de cr\u00e9er ou de favoriser des conditions conduisant \u00e0 un d\u00e9placement forc\u00e9 massif.<\/p>\n<p data-start=\"3109\" data-end=\"3679\">Dans tous les cas, l\u2019efficacit\u00e9 de ces avertissements n\u2019affecte pas la protection juridique continue accord\u00e9e aux civils. Les civils qui ne quittent pas leurs zones ne doivent en aucun cas \u00eatre consid\u00e9r\u00e9s comme des cibles l\u00e9gitimes d\u2019attaque. De plus, les personnes qui choisissent de rester chez elles, ou qui sont incapables de partir en raison de contraintes objectives \u2014 notamment un handicap, l\u2019\u00e2ge avanc\u00e9 ou d\u2019autres raisons \u2014 demeurent pleinement prot\u00e9g\u00e9es par le droit international humanitaire, et cette protection ne peut \u00eatre enfreinte en aucune circonstance.<\/p>\n<p data-start=\"1005\" data-end=\"1623\"><a href=\"https:\/\/www.unocha.org\/publications\/report\/lebanon\/lebanon-flash-update-9-escalation-hostilities-lebanon-16-march-2026\" target=\"_blank\" rel=\"noopener\">Selon le Bureau des Nations Unies pour la coordination des affaires humanitaires (OCHA)<\/a>, \u00e0 la date du 16 mars, les ordres d\u2019\u00e9vacuation isra\u00e9liens couvraient environ 1 470 kilom\u00e8tres carr\u00e9s, soit pr\u00e8s de 14 % de la superficie totale du Liban. De nombreuses familles ont \u00e9t\u00e9 contraintes de se d\u00e9placer \u00e0 plusieurs reprises \u00e0 mesure que les hostilit\u00e9s s\u2019\u00e9tendaient \u00e0 de nouvelles zones. Seuls environ 12,5 % (132 742 personnes) des d\u00e9plac\u00e9s enregistr\u00e9s r\u00e9sident dans des centres d\u2019h\u00e9bergement collectifs, tandis que les autres d\u00e9pendent de familles d\u2019accueil ou de solutions informelles.<\/p>\n<p data-start=\"1625\" data-end=\"2174\">Dans plusieurs villages du sud, notamment \u00e0 Shabriha dans le district de Tyr, des rapports indiquent que les \u00e9quipes de la d\u00e9fense civile ou les municipalit\u00e9s ont re\u00e7u des instructions visant \u00e0 \u00e9vacuer de force les habitants restants. Dans un d\u00e9veloppement notable, il a \u00e9t\u00e9 signal\u00e9 que les forces isra\u00e9liennes ont \u00e9mis un ordre d\u2019\u00e9vacuation individuel via l\u2019application WhatsApp, demandant \u00e0 un r\u00e9sident \u00e0 Beyrouth de quitter son appartement et les bureaux de son entreprise \u2014 une premi\u00e8re de ce type rapport\u00e9e dans le cadre de l\u2019escalade actuelle.<\/p>\n<p data-start=\"1106\" data-end=\"1522\">Pour qu\u2019un avertissement soit efficace, il doit \u00eatre \u00e9mis en temps opportun et contenir des informations claires sur les itin\u00e9raires s\u00fbrs et les destinations vers lesquelles les civils peuvent se diriger. La Commission nationale des droits de l\u2019homme a examin\u00e9 un certain nombre de ces avertissements et \u00e9valu\u00e9 leur conformit\u00e9 aux normes pr\u00e9vues par le droit international humanitaire.<\/p>\n<p data-start=\"1524\" data-end=\"2327\"><a href=\"https:\/\/x.com\/AvichayAdraee\/status\/2032157844066148625\" target=\"_blank\" rel=\"noopener\">L\u2019avertissement \u00e9mis le 12 mars 2026 par le porte-parole de l\u2019arm\u00e9e isra\u00e9lienne, Avichay Adraee,<\/a> via la plateforme \u00ab X \u00bb, concernant la zone d\u2019Amroussieh dans la banlieue sud de Beyrouth, met en \u00e9vidence des probl\u00e9matiques li\u00e9es aux exigences d\u2019efficacit\u00e9, de clart\u00e9 et de pr\u00e9cision des avertissements pr\u00e9alables. L\u2019avertissement comportait une instruction g\u00e9n\u00e9rale d\u2019\u00e9vacuation imm\u00e9diate \u00e0 une distance d\u2019au moins 300 m\u00e8tres sur la base d\u2019une carte jointe. Toutefois, il s\u2019est av\u00e9r\u00e9 que cette carte incluait un b\u00e2timent d\u00e9sign\u00e9 comme \u00ab Grand Cinema ABC Verdun \u00bb, alors que celui-ci se situe \u00e0 au moins 11 kilom\u00e8tres de la zone vis\u00e9e, ce qui a provoqu\u00e9 une confusion et induit les habitants en erreur \u2014 en contradiction avec l\u2019exigence de clart\u00e9 et de pr\u00e9cision requise pour ce type d\u2019avertissements.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5604\" src=\"https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam.jpeg\" alt=\"\" width=\"2048\" height=\"1152\" srcset=\"https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam.jpeg 2048w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-300x169.jpeg 300w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-1024x576.jpeg 1024w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-768x432.jpeg 768w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-1536x864.jpeg 1536w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-150x84.jpeg 150w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-696x392.jpeg 696w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-1068x601.jpeg 1068w, https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/HDOsySHXIAECgam-1920x1080.jpeg 1920w\" sizes=\"auto, (max-width: 2048px) 100vw, 2048px\" \/><\/p>\n<p data-start=\"1619\" data-end=\"2470\">La Commission nationale des droits de l\u2019homme a \u00e9galement constat\u00e9 que cette zone avait d\u00e9j\u00e0 fait l\u2019objet d\u2019un avertissement similaire en 2024, utilisant la m\u00eame carte et comportant les m\u00eames informations trompeuses concernant l\u2019emplacement de l\u2019ABC \u00e0 Verdun. Cela met en \u00e9vidence de s\u00e9rieux indices d\u2019un d\u00e9faut de mise \u00e0 jour des bases de donn\u00e9es utilis\u00e9es, m\u00eame lorsqu\u2019elles contiennent des erreurs d\u2019une telle ampleur. Cela soul\u00e8ve, \u00e0 son tour, de s\u00e9rieuses interrogations quant au respect du principe de proportionnalit\u00e9 et de l\u2019obligation de prendre toutes les pr\u00e9cautions possibles pour prot\u00e9ger les civils. Si le caract\u00e8re trompeur ou insuffisant de ces avertissements est \u00e9tabli, cela pourrait constituer une violation des obligations incombant aux parties au conflit en vertu du droit international humanitaire.<\/p>\n<p data-start=\"2472\" data-end=\"3078\">Les avertissements r\u00e9p\u00e9t\u00e9s adress\u00e9s aux habitants de la banlieue sud de Beyrouth \u2014 en particulier ceux accompagn\u00e9s de cartes publi\u00e9es par les forces isra\u00e9liennes \u2014 r\u00e9v\u00e8lent de s\u00e9rieux probl\u00e8mes juridiques en mati\u00e8re de pr\u00e9cision, de clart\u00e9 et d\u2019efficacit\u00e9. Ces avertissements ont couvert sept zones distinctes : Haret Hreik, Ghobeiry, Laylaki, Hadath, Burj el-Barajneh, Tahwitat al-Ghadir et Chiyah. Ils se sont av\u00e9r\u00e9s trompeurs, dans la mesure o\u00f9 ils englobaient de vastes zones incluant des quartiers r\u00e9sidentiels qui n\u2019ont pas \u00e9t\u00e9 effectivement bombard\u00e9s, notamment \u00e0 Hadath, Furn El Chebbak et Hazmieh.<\/p>\n<p data-start=\"3080\" data-end=\"3389\">Il est \u00e9galement apparu qu\u2019il existait un d\u00e9calage entre les limites administratives des municipalit\u00e9s incluses dans les cartes d\u2019avertissement de l\u2019arm\u00e9e isra\u00e9lienne et les zones r\u00e9ellement touch\u00e9es par les menaces ou les frappes, ce qui refl\u00e8te un d\u00e9faut dans la d\u00e9limitation pr\u00e9cise du p\u00e9rim\u00e8tre de danger.<\/p>\n<p data-start=\"2823\" data-end=\"3693\">Dans tous ces cas, des dizaines d\u2019avertissements de bombardement cibl\u00e9s \u00e9mis dans la banlieue sud de Beyrouth ont montr\u00e9 que la zone ombr\u00e9e sur les cartes \u2014 cens\u00e9e d\u00e9finir l\u2019\u00e9tendue du danger imm\u00e9diat pour les civils \u2014 \u00e9tait bien inf\u00e9rieure au rayon de 500 m\u00e8tres que les forces isra\u00e9liennes ont demand\u00e9 d\u2019\u00e9vacuer comme distance minimale de s\u00e9curit\u00e9. Cette contradiction entre la repr\u00e9sentation visuelle et le p\u00e9rim\u00e8tre d\u2019\u00e9vacuation exig\u00e9 entra\u00eene une confusion chez les civils et compromet leur capacit\u00e9 \u00e0 prendre des d\u00e9cisions \u00e9clair\u00e9es concernant leur s\u00e9curit\u00e9. Elle soul\u00e8ve de s\u00e9rieuses interrogations quant au respect des exigences de clart\u00e9, de pr\u00e9cision et d\u2019efficacit\u00e9, et pourrait constituer un manquement \u00e0 l\u2019obligation de prendre les pr\u00e9cautions n\u00e9cessaires pour prot\u00e9ger les civils au regard du droit international humanitaire.<\/p>\n<p data-start=\"3695\" data-end=\"4750\"><a href=\"https:\/\/nhrclb.org\/protocol-additional-geneva-conventions-12-august-1949\" target=\"_blank\" rel=\"noopener\">L\u2019article 57 du Protocole additionnel I aux Conventions de Gen\u00e8ve de 1977<\/a>, au paragraphe 2(c), pr\u00e9voit l\u2019obligation de \u00ab donner un avertissement pr\u00e9alable efficace des attaques qui peuvent affecter la population civile, sauf si les circonstances ne le permettent pas \u00bb. Il ressort de cette disposition que le crit\u00e8re d\u2019efficacit\u00e9 n\u2019est pas purement formel ; il exige que l\u2019avertissement soit clair, pr\u00e9cis et ex\u00e9cutoire, de mani\u00e8re \u00e0 permettre aux civils de prendre des mesures r\u00e9alistes pour \u00e9viter les dangers. Par cons\u00e9quent, les avertissements vagues, excessivement g\u00e9n\u00e9raux ou appelant \u00e0 l\u2019\u00e9vacuation de zones \u00e9tendues sans d\u00e9finir avec pr\u00e9cision l\u2019\u00e9tendue du danger ni fournir des orientations pratiques ne r\u00e9pondent pas aux exigences de cet article. De tels avertissements perdent la condition d\u2019efficacit\u00e9 express\u00e9ment requise et peuvent exposer les civils \u00e0 des risques suppl\u00e9mentaires ou conduire \u00e0 un d\u00e9placement forc\u00e9 injustifi\u00e9, constituant ainsi une violation de l\u2019obligation de prendre des pr\u00e9cautions pour prot\u00e9ger la population civile.<\/p>\n<p data-start=\"4752\" data-end=\"5928\"><a href=\"https:\/\/nhrclb.org\/fr\/archives\/5594\" target=\"_blank\" rel=\"noopener\">Les Principes directeurs relatifs au d\u00e9placement interne<\/a>, en particulier le principe 5, disposent que \u00ab dans toutes les circonstances, les autorit\u00e9s et les acteurs internationaux doivent respecter leurs obligations en vertu du droit international, y compris le droit international des droits de l\u2019homme et le droit international humanitaire, afin de pr\u00e9venir et d\u2019\u00e9viter les conditions susceptibles d\u2019entra\u00eener des d\u00e9placements de personnes \u00bb. Dans ce contexte, l\u2019ampleur g\u00e9ographique des avertissements isra\u00e9liens au Liban et leur extension \u00e0 de vastes zones suscitent de vives inqui\u00e9tudes quant \u00e0 leur compatibilit\u00e9 avec ce principe, notamment si ces avertissements conduisent effectivement \u00e0 pousser les populations vers un d\u00e9placement massif sans garanties suffisantes de s\u00e9curit\u00e9 ni alternatives appropri\u00e9es.
