Dans des contextes marqu\u00e9s par les conflits, l\u2019instabilit\u00e9 politique et le renforcement de la coop\u00e9ration s\u00e9curitaire r\u00e9gionale, les risques de telles pratiques suscitent une inqui\u00e9tude croissante.<\/p>\n<p data-start=\"6715\" data-end=\"7113\"><strong data-start=\"6715\" data-end=\"6753\">D\u00e9finition et interdiction absolue<\/strong><br data-start=\"6753\" data-end=\"6756\" \/>La Convention internationale pour la protection de toutes les personnes contre les disparitions forc\u00e9es (2006) d\u00e9finit la disparition forc\u00e9e comme toute forme de privation de libert\u00e9 inflig\u00e9e par des agents de l\u2019\u00c9tat ou avec son autorisation, suivie du refus de reconna\u00eetre cette privation ou de la dissimulation du sort ou du lieu o\u00f9 se trouve la personne.<\/p>\n<p data-start=\"7115\" data-end=\"7373\">La Convention affirme clairement qu\u2019aucune circonstance exceptionnelle, qu\u2019il s\u2019agisse d\u2019un \u00e9tat de guerre, d\u2019instabilit\u00e9 politique ou d\u2019urgence publique, ne peut \u00eatre invoqu\u00e9e pour justifier une disparition forc\u00e9e, consacrant ainsi son interdiction absolue.<\/p>\n<p data-start=\"7375\" data-end=\"7655\"><strong data-start=\"7375\" data-end=\"7424\">Une violation multiple de droits fondamentaux<\/strong><br data-start=\"7424\" data-end=\"7427\" \/>La disparition forc\u00e9e constitue une violation continue et complexe des droits humains, incluant le droit \u00e0 la libert\u00e9, \u00e0 la s\u00e9curit\u00e9, \u00e0 la protection contre la torture, au droit \u00e0 la vie, ainsi qu\u2019au droit \u00e0 un recours effectif.<\/p>\n<p data-start=\"7657\" data-end=\"7945\">Les instances internationales ont \u00e9tabli un lien \u00e9troit entre disparition forc\u00e9e et torture. L\u2019interdiction de la torture est une norme imp\u00e9rative du droit international (jus cogens), contraignante pour tous les \u00c9tats, impliquant l\u2019obligation d\u2019enqu\u00eater et de poursuivre les responsables.<\/p>\n<p data-start=\"7947\" data-end=\"8136\"><strong data-start=\"7947\" data-end=\"8002\">Garanties juridiques contre la d\u00e9tention arbitraire<\/strong><br data-start=\"8002\" data-end=\"8005\" \/>Le Pacte international relatif aux droits civils et politiques, auquel le Liban a adh\u00e9r\u00e9 en 1972, offre des garanties essentielles.<\/p>\n<p data-start=\"8138\" data-end=\"8448\">L\u2019article 9 garantit le droit \u00e0 la libert\u00e9 et interdit la d\u00e9tention arbitraire, tout en assurant le droit de contester la l\u00e9galit\u00e9 de la d\u00e9tention devant un tribunal. L\u2019article 14 garantit le droit \u00e0 un proc\u00e8s \u00e9quitable, incluant la pr\u00e9somption d\u2019innocence, le droit \u00e0 la d\u00e9fense et \u00e0 l\u2019assistance d\u2019un avocat.<\/p>\n<p data-start=\"8450\" data-end=\"8537\">Ces garanties sont essentielles pour pr\u00e9venir les d\u00e9tentions secr\u00e8tes ou non reconnues.<\/p>\n<p data-start=\"8539\" data-end=\"8813\"><strong data-start=\"8539\" data-end=\"8602\">Les obligations du Liban en droit international humanitaire<\/strong><br data-start=\"8602\" data-end=\"8605\" \/>Le Liban est partie aux Conventions de Gen\u00e8ve de 1949 et au Protocole additionnel II, qui imposent un traitement humain des personnes priv\u00e9es de libert\u00e9 et interdisent la torture et les traitements inhumains.<\/p>\n<p data-start=\"8815\" data-end=\"8939\">L\u2019interdiction de la disparition forc\u00e9e fait \u00e9galement partie du droit international coutumier, s\u2019imposant \u00e0 tous les \u00c9tats.<\/p>\n<p data-start=\"8941\" data-end=\"9250\"><strong data-start=\"8941\" data-end=\"8979\">Indicateurs sur le terrain en 2025<\/strong><br data-start=\"8979\" data-end=\"8982\" \/>Plusieurs incidents en 2025 au Liban ont impliqu\u00e9 des formes de privation ill\u00e9gale de libert\u00e9, notamment dans les zones frontali\u00e8res, incluant des enl\u00e8vements suivis d\u2019op\u00e9rations de lib\u00e9ration, ainsi que des arrestations li\u00e9es \u00e0 l\u2019entr\u00e9e irr\u00e9guli\u00e8re sur le territoire.<\/p>\n<p data-start=\"9252\" data-end=\"9358\">Ces \u00e9v\u00e9nements mettent en \u00e9vidence les risques li\u00e9s \u00e0 des pratiques de d\u00e9tention insuffisamment encadr\u00e9es.<\/p>\n<p data-start=\"9360\" data-end=\"9715\"><br data-start=\"9428\" data-end=\"9431\" \/>Dans ce contexte, l\u2019affaire d\u2019Abdulrahman Youssef al-Qaradawi illustre les risques li\u00e9s \u00e0 la coop\u00e9ration s\u00e9curitaire r\u00e9gionale. Apr\u00e8s son arrestation au Liban et son transfert vers les \u00c9mirats arabes unis, son sort demeure incertain, ce qui pourrait constituer une disparition forc\u00e9e.<\/p>\n<p data-start=\"9717\" data-end=\"9874\">Des experts des Nations unies ont exprim\u00e9 leurs pr\u00e9occupations quant \u00e0 une possible violation du principe de non-refoulement et ont appel\u00e9 \u00e0 la transparence.<\/p>\n<p data-start=\"9876\" data-end=\"10190\"><br data-start=\"9890\" data-end=\"9893\" \/>La disparition forc\u00e9e est strictement interdite en droit international et constitue une violation grave pouvant engager la responsabilit\u00e9 internationale des \u00c9tats.
