Nika Kvaratskheklia, Chef de l\u2019\u00e9quipe r\u00e9gionale Asie-Pacifique du SPT<\/strong>. Cette contribution repr\u00e9sente la participation du Liban \u00e0 l\u2019\u00e9laboration d\u2019un <strong data-start=\"961\" data-end=\"1011\">Commentaire g\u00e9n\u00e9ral sur l\u2019article 4 de l\u2019OPCAT<\/strong>, l\u2019une des dispositions les plus importantes r\u00e9gissant la port\u00e9e du contr\u00f4le pr\u00e9ventif des lieux o\u00f9 des personnes peuvent \u00eatre priv\u00e9es de leur libert\u00e9.<\/p>\n<p data-start=\"1165\" data-end=\"1589\">Cette communication a \u00e9t\u00e9 soumise par le <strong data-start=\"1206\" data-end=\"1257\">M\u00e9canisme national de pr\u00e9vention du Liban (NPM)<\/strong>, repr\u00e9sent\u00e9 par le <strong data-start=\"1277\" data-end=\"1320\">Comit\u00e9 pour la pr\u00e9vention de la torture<\/strong>, agissant dans le cadre de son mandat en vertu de <strong data-start=\"1371\" data-end=\"1401\">l\u2019article 20(f) de l\u2019OPCAT<\/strong> et de <strong data-start=\"1408\" data-end=\"1472\">l\u2019article 27(b) de la loi libanaise n\u00b0 62 du 27 octobre 2016<\/strong>, qui a \u00e9tabli la <strong data-start=\"1490\" data-end=\"1588\">Commission nationale des droits de l\u2019homme incluant le Comit\u00e9 pour la pr\u00e9vention de la torture<\/strong>.<\/p>\n<h3 data-section-id=\"1i0i033\" data-start=\"1591\" data-end=\"1670\">Renforcer les orientations internationales pour la pr\u00e9vention de la torture<\/h3>\n<p data-start=\"1672\" data-end=\"2123\">L\u2019article 4 de l\u2019OPCAT est largement consid\u00e9r\u00e9 comme une pierre angulaire du syst\u00e8me mondial de pr\u00e9vention de la torture. Il d\u00e9finit l\u2019\u00e9tendue du mandat de surveillance confi\u00e9 \u00e0 la fois au <strong data-start=\"1861\" data-end=\"1915\">Sous-Comit\u00e9 pour la pr\u00e9vention de la torture (SPT)<\/strong> et aux <strong data-start=\"1923\" data-end=\"1967\">m\u00e9canismes nationaux de pr\u00e9vention (NPM)<\/strong> \u00e0 travers le monde, notamment en ce qui concerne les types de lieux qu\u2019ils sont autoris\u00e9s \u00e0 visiter afin de pr\u00e9venir la torture et les mauvais traitements.<\/p>\n<p data-start=\"2125\" data-end=\"2557\">Dans sa contribution, la <strong data-start=\"2150\" data-end=\"2162\">NHRC-CPT<\/strong> souligne que <strong data-start=\"2176\" data-end=\"2364\">l\u2019interpr\u00e9tation correcte et l\u2019application pratique de l\u2019article 4 sont essentielles pour garantir que les \u00c9tats parties remplissent effectivement leurs obligations au titre de l\u2019OPCAT<\/strong>. Le document met en \u00e9vidence l\u2019importance d\u2019adopter une interpr\u00e9tation large et finaliste de la notion de <strong data-start=\"2471\" data-end=\"2508\">\u00ab lieux de privation de libert\u00e9 \u00bb<\/strong>, conforme \u00e0 l\u2019esprit pr\u00e9ventif de la Convention.<\/p>\n<p data-start=\"2559\" data-end=\"3025\">L\u2019analyse de la Commission rappelle que <strong data-start=\"2599\" data-end=\"2657\">l\u2019article 4(1) de l\u2019OPCAT \u00e9tablit une d\u00e9finition large<\/strong>, obligeant les \u00c9tats \u00e0 permettre des visites tant par les m\u00e9canismes nationaux de pr\u00e9vention que par le SPT dans tout lieu relevant de leur juridiction ou de leur contr\u00f4le o\u00f9 des personnes sont ou peuvent \u00eatre priv\u00e9es de leur libert\u00e9, que ce soit <strong data-start=\"2905\" data-end=\"3024\">en vertu d\u2019un ordre formel d\u2019une autorit\u00e9 publique ou avec son consentement, son acquiescement ou \u00e0 son instigation<\/strong>.<\/p>\n<p data-start=\"3027\" data-end=\"3312\">Cette interpr\u00e9tation d\u00e9passe les lieux de d\u00e9tention traditionnels tels que les <strong data-start=\"3106\" data-end=\"3178\">prisons, les postes de police ou les centres de d\u00e9tention provisoire<\/strong>, et englobe un \u00e9ventail plus large d\u2019institutions dans lesquelles des individus peuvent \u00eatre priv\u00e9s de leur libert\u00e9 dans la pratique.<\/p>\n<h3 data-section-id=\"1ta9yjb\" data-start=\"3314\" data-end=\"3356\">\u00c9largir le champ du contr\u00f4le pr\u00e9ventif<\/h3>\n<p data-start=\"3358\" data-end=\"3728\">La contribution de la NHRC-CPT souligne que le cadre pr\u00e9ventif \u00e9tabli par l\u2019OPCAT exige de reconna\u00eetre que la privation de libert\u00e9 peut survenir <strong data-start=\"3503\" data-end=\"3546\">dans des contextes publics comme priv\u00e9s<\/strong>, y compris dans des institutions o\u00f9 les personnes sont plac\u00e9es sous la supervision d\u2019acteurs non \u00e9tatiques, mais <strong data-start=\"3660\" data-end=\"3727\">avec la connaissance ou le consentement des autorit\u00e9s publiques<\/strong>.<\/p>\n<p data-start=\"3730\" data-end=\"4083\">Ainsi, la Commission souligne que des institutions telles que <strong data-start=\"3792\" data-end=\"3933\">les h\u00f4pitaux priv\u00e9s, les \u00e9tablissements psychiatriques, les maisons de retraite, les centres de r\u00e9habilitation ou les foyers pour enfants<\/strong> peuvent \u00e9galement entrer dans le champ d\u2019application de l\u2019article 4 lorsque les personnes qui y sont plac\u00e9es ne sont pas libres de partir \u00e0 leur gr\u00e9.<\/p>\n<p data-start=\"4085\" data-end=\"4514\">Le document aborde \u00e9galement une <strong data-start=\"4118\" data-end=\"4206\">tension interpr\u00e9tative potentielle entre l\u2019article 4(1) et l\u2019article 4(2) de l\u2019OPCAT<\/strong>. Alors que l\u2019article 4(1) adopte une formulation large couvrant les situations impliquant le consentement ou l\u2019acquiescement des autorit\u00e9s publiques, l\u2019article 4(2) d\u00e9finit la privation de libert\u00e9 de mani\u00e8re plus restrictive comme une d\u00e9tention ordonn\u00e9e par une autorit\u00e9 judiciaire, administrative ou autre.<\/p>\n<p data-start=\"4516\" data-end=\"4951\">La Commission soutient qu\u2019<strong data-start=\"4542\" data-end=\"4712\">une interpr\u00e9tation syst\u00e9matique et t\u00e9l\u00e9ologique du Protocole exige que l\u2019article 4(2) soit interpr\u00e9t\u00e9 \u00e0 la lumi\u00e8re de la d\u00e9finition plus large pr\u00e9vue \u00e0 l\u2019article 4(1)<\/strong>. Une telle interpr\u00e9tation est conforme \u00e0 l\u2019objectif fondamental de l\u2019OPCAT, qui vise \u00e0 pr\u00e9venir la torture gr\u00e2ce \u00e0 une <strong data-start=\"4832\" data-end=\"4950\">surveillance proactive de tous les environnements o\u00f9 les personnes peuvent \u00eatre expos\u00e9es \u00e0 des mauvais traitements<\/strong>.<\/p>\n<h3 data-section-id=\"1o6p1tf\" data-start=\"4953\" data-end=\"4991\">Interaction avec le droit libanais<\/h3>\n<p data-start=\"4993\" data-end=\"5115\">La publication examine \u00e9galement la mani\u00e8re dont ces normes internationales s\u2019articulent avec le cadre juridique libanais.<\/p>\n<p data-start=\"5117\" data-end=\"5394\">La <strong data-start=\"5120\" data-end=\"5162\">loi libanaise n\u00b0 62 du 27 octobre 2016<\/strong>, qui a \u00e9tabli la Commission nationale des droits de l\u2019homme et le Comit\u00e9 pour la pr\u00e9vention de la torture, a adopt\u00e9 une d\u00e9finition de la privation de libert\u00e9 qui refl\u00e8te en grande partie le libell\u00e9 de <strong data-start=\"5364\" data-end=\"5393\">l\u2019article 4(2) de l\u2019OPCAT<\/strong>.<\/p>\n<p data-start=\"5396\" data-end=\"5670\">L\u2019<strong data-start=\"5398\" data-end=\"5415\">article 22(B)<\/strong> de cette loi d\u00e9finit la privation de libert\u00e9 comme <strong data-start=\"5467\" data-end=\"5669\">toute forme de d\u00e9tention ou de placement dans un \u00e9tablissement de garde dont une personne ne peut sortir librement en vertu d\u2019une d\u00e9cision judiciaire, administrative ou d\u2019une autre autorit\u00e9 publique<\/strong>.<\/p>\n<p data-start=\"5672\" data-end=\"5752\">La loi \u00e9num\u00e8re plusieurs institutions entrant dans cette d\u00e9finition, notamment :<\/p>\n<ul data-start=\"5754\" data-end=\"5935\">\n<li data-section-id=\"1819qvm\" data-start=\"5754\" data-end=\"5794\">\n<p data-start=\"5756\" data-end=\"5794\">les prisons et centres de d\u00e9tention,<\/p>\n<\/li>\n<li data-section-id=\"1rb1559\" data-start=\"5795\" data-end=\"5820\">\n<p data-start=\"5797\" data-end=\"5820\">les postes de police,<\/p>\n<\/li>\n<li data-section-id=\"47ps6d\" data-start=\"5821\" data-end=\"5850\">\n<p data-start=\"5823\" data-end=\"5850\">les centres pour mineurs,<\/p>\n<\/li>\n<li data-section-id=\"czz89s\" data-start=\"5851\" data-end=\"5882\">\n<p data-start=\"5853\" data-end=\"5882\">les ports et les a\u00e9roports,<\/p>\n<\/li>\n<li data-section-id=\"erim0h\" data-start=\"5883\" data-end=\"5935\">\n<p data-start=\"5885\" data-end=\"5935\">les h\u00f4pitaux et les \u00e9tablissements psychiatriques.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"5937\" data-end=\"6210\">Elle identifie \u00e9galement les autorit\u00e9s responsables de la supervision de ces lieux, notamment <strong data-start=\"6031\" data-end=\"6209\">les Forces de s\u00e9curit\u00e9 int\u00e9rieure, la S\u00fbret\u00e9 g\u00e9n\u00e9rale, la S\u00e9curit\u00e9 de l\u2019\u00c9tat, l\u2019Administration des douanes, le Minist\u00e8re de la D\u00e9fense nationale et le Minist\u00e8re de la Justice<\/strong>.<\/p>\n<p data-start=\"6212\" data-end=\"6491\">Toutefois, la Commission souligne que cette d\u00e9finition <strong data-start=\"6267\" data-end=\"6414\">n\u2019inclut pas explicitement les situations o\u00f9 la privation de libert\u00e9 intervient avec le consentement ou l\u2019acquiescement des autorit\u00e9s publiques<\/strong>, ce qui pourrait limiter, dans la pratique, l\u2019\u00e9tendue du contr\u00f4le pr\u00e9ventif.<\/p>\n<p data-start=\"6493\" data-end=\"6852\">Afin de combler cette lacune, le Comit\u00e9 a annonc\u00e9 son intention de travailler avec les autorit\u00e9s libanaises, notamment <strong data-start=\"6612\" data-end=\"6649\">le Minist\u00e8re de la Sant\u00e9 publique<\/strong>, afin de d\u00e9velopper des garanties relatives aux <strong data-start=\"6698\" data-end=\"6740\">mesures de privation de libert\u00e9 (DoLS)<\/strong> pour les personnes souffrant de troubles mentaux et les personnes \u00e2g\u00e9es, y compris celles atteintes de d\u00e9mence.<\/p>\n<h3 data-section-id=\"16bd4qu\" data-start=\"6854\" data-end=\"6904\">Enseignements tir\u00e9s de la pand\u00e9mie de COVID-19<\/h3>\n<p data-start=\"6906\" data-end=\"7160\">La contribution documente \u00e9galement les d\u00e9fis pratiques rencontr\u00e9s par le m\u00e9canisme national de pr\u00e9vention du Liban durant la <strong data-start=\"7032\" data-end=\"7056\">pand\u00e9mie de COVID-19<\/strong>, soulignant comment les situations d\u2019urgence peuvent r\u00e9v\u00e9ler les faiblesses des m\u00e9canismes de contr\u00f4le.<\/p>\n<p data-start=\"7162\" data-end=\"7483\">Pendant la pand\u00e9mie, le Comit\u00e9 s\u2019est efforc\u00e9 de mettre en \u0153uvre les orientations \u00e9mises par le <strong data-start=\"7257\" data-end=\"7371\">Sous-Comit\u00e9 pour la pr\u00e9vention de la torture \u00e0 l\u2019intention des \u00c9tats parties et des NPM concernant la COVID-19<\/strong>, qui soulignaient l\u2019importance de maintenir les m\u00e9canismes de surveillance pr\u00e9ventive m\u00eame en p\u00e9riode de crise.<\/p>\n<p data-start=\"7485\" data-end=\"7935\">Le <strong data-start=\"7488\" data-end=\"7504\">22 mars 2020<\/strong>, le Comit\u00e9 a adress\u00e9 une lettre au Premier ministre libanais demandant les moyens n\u00e9cessaires et des mesures de renforcement des capacit\u00e9s afin que les membres et experts du m\u00e9canisme national de pr\u00e9vention puissent continuer \u00e0 exercer leur mandat, notamment en effectuant des visites dans <strong data-start=\"7795\" data-end=\"7839\">les lieux de quarantaine et les h\u00f4pitaux<\/strong>, o\u00f9 les individus pouvaient \u00eatre soumis \u00e0 des conditions \u00e9quivalant \u00e0 une privation de libert\u00e9.<\/p>\n<p data-start=\"7937\" data-end=\"8281\">Bien que le <strong data-start=\"7949\" data-end=\"7983\">Minist\u00e8re de la Sant\u00e9 publique<\/strong> ait indiqu\u00e9 initialement que certains centres de quarantaine n\u2019avaient pas encore \u00e9t\u00e9 utilis\u00e9s, les tentatives ult\u00e9rieures du Comit\u00e9 pour visiter des h\u00f4pitaux d\u00e9sign\u00e9s pour la quarantaine ont \u00e9t\u00e9 entrav\u00e9es par <strong data-start=\"8194\" data-end=\"8254\">l\u2019absence d\u2019\u00e9quipements de protection individuelle (EPI)<\/strong> fournis par les autorit\u00e9s.<\/p>\n<p data-start=\"8283\" data-end=\"8747\">Par ailleurs, les discussions tenues en <strong data-start=\"8323\" data-end=\"8339\">janvier 2021<\/strong> avec une commission gouvernementale mise en place par le <strong data-start=\"8397\" data-end=\"8425\">Minist\u00e8re de l\u2019Int\u00e9rieur<\/strong> pour g\u00e9rer la situation dans les prisons et centres de d\u00e9tention pendant la pand\u00e9mie ont r\u00e9v\u00e9l\u00e9 que la d\u00e9finition des lieux de privation de libert\u00e9 utilis\u00e9e dans la pratique \u00e9tait limit\u00e9e principalement <strong data-start=\"8629\" data-end=\"8672\">aux prisons et aux centres de d\u00e9tention<\/strong>, excluant d\u2019autres institutions o\u00f9 des personnes pouvaient \u00eatre confin\u00e9es.<\/p>\n<p data-start=\"8749\" data-end=\"8976\">Ces exp\u00e9riences mettent en \u00e9vidence la n\u00e9cessit\u00e9 de disposer de <strong data-start=\"8813\" data-end=\"8885\">d\u00e9finitions juridiques claires et d\u2019un soutien institutionnel solide<\/strong> afin de permettre aux m\u00e9canismes de pr\u00e9vention d\u2019op\u00e9rer efficacement en p\u00e9riode d\u2019urgence.<\/p>\n<h3 data-section-id=\"1rlhh2u\" data-start=\"8978\" data-end=\"9027\">Renforcer le m\u00e9canisme national de pr\u00e9vention<\/h3>\n<p data-start=\"9029\" data-end=\"9167\">La communication soul\u00e8ve \u00e9galement certaines pr\u00e9occupations concernant la conformit\u00e9 du Liban \u00e0 certaines obligations pr\u00e9vues par l\u2019OPCAT.<\/p>\n<p data-start=\"9169\" data-end=\"9371\">Le Liban a ratifi\u00e9 l\u2019OPCAT le <strong data-start=\"9199\" data-end=\"9219\">22 d\u00e9cembre 2008<\/strong>, s\u2019engageant ainsi \u00e0 \u00e9tablir et \u00e0 soutenir un <strong data-start=\"9266\" data-end=\"9326\">m\u00e9canisme national de pr\u00e9vention efficace et ind\u00e9pendant<\/strong> charg\u00e9 de surveiller les lieux de d\u00e9tention.<\/p>\n<p data-start=\"9373\" data-end=\"9492\">Cependant, le Comit\u00e9 souligne plusieurs d\u00e9fis qui ont affect\u00e9 la mise en \u0153uvre compl\u00e8te de ces obligations, notamment :<\/p>\n<ul data-start=\"9494\" data-end=\"9988\">\n<li data-section-id=\"n7e3mq\" data-start=\"9494\" data-end=\"9598\">\n<p data-start=\"9496\" data-end=\"9598\"><strong data-start=\"9496\" data-end=\"9547\">l\u2019absence de ressources financi\u00e8res suffisantes<\/strong> allou\u00e9es \u00e0 la NHRC-CPT dans le budget de l\u2019\u00c9tat,<\/p>\n<\/li>\n<li data-section-id=\"egjq0x\" data-start=\"9599\" data-end=\"9748\">\n<p data-start=\"9601\" data-end=\"9748\">les retards dans l\u2019adoption et la publication de tous les <strong data-start=\"9659\" data-end=\"9745\">d\u00e9crets d\u2019application n\u00e9cessaires \u00e0 la mise en \u0153uvre compl\u00e8te de la loi n\u00b0 62\/2016<\/strong>,<\/p>\n<\/li>\n<li data-section-id=\"x6v51v\" data-start=\"9749\" data-end=\"9988\">\n<p data-start=\"9751\" data-end=\"9988\">et la n\u00e9cessit\u00e9 de modifier certaines dispositions de la loi afin de garantir une conformit\u00e9 totale avec <strong data-start=\"9856\" data-end=\"9883\">l\u2019article 18 de l\u2019OPCAT<\/strong> et avec les <strong data-start=\"9896\" data-end=\"9987\">Principes de Paris relatifs au statut des institutions nationales des droits de l\u2019homme<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"9990\" data-end=\"10191\">Assurer un financement ad\u00e9quat et garantir l\u2019ind\u00e9pendance institutionnelle demeurent des conditions essentielles pour permettre au m\u00e9canisme national de pr\u00e9vention d\u2019exercer efficacement ses fonctions.<\/p>\n<h3 data-section-id=\"qbq8kj\" data-start=\"10193\" data-end=\"10252\">Cartographie des lieux de privation de libert\u00e9 au Liban<\/h3>\n<p data-start=\"10254\" data-end=\"10425\">Dans le cadre de sa contribution, le Comit\u00e9 data-start=\"11437\" data-end=\"11539\">\n<p data-start=\"11439\" data-end=\"11539\">les <strong data-start=\"11443\" data-end=\"11492\">orphelinats, refuges et institutions sociales<\/strong> relevant du Minist\u00e8re des Affaires sociales,<\/p>\n<\/li>\n<li data-section-id=\"cmr58h\" data-start=\"11540\" data-end=\"11657\">\n<p data-start=\"11542\" data-end=\"11657\">les <strong data-start=\"11546\" data-end=\"11586\">internats et institutions \u00e9ducatives<\/strong> relevant du Minist\u00e8re de l\u2019\u00c9ducation et de l\u2019Enseignement sup\u00e9rieur,<\/p>\n<\/li>\n<li data-section-id=\"c6ebyr\" data-start=\"11658\" data-end=\"11759\">\n<p data-start=\"11660\" data-end=\"11759\">ainsi que les <strong data-start=\"11674\" data-end=\"11716\">centres de r\u00e9habilitation pour mineurs<\/strong> supervis\u00e9s par le Minist\u00e8re de la Justice.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"11761\" data-end=\"12039\">Cette cartographie refl\u00e8te la philosophie pr\u00e9ventive de l\u2019OPCAT, qui reconna\u00eet que <strong data-start=\"11844\" data-end=\"12038\">les risques de torture ou de mauvais traitements peuvent survenir dans tout environnement o\u00f9 des personnes sont plac\u00e9es sous contr\u00f4le institutionnel et ne peuvent quitter librement les lieux<\/strong>.<\/p>\n<h3 data-section-id=\"18gyg45\" data-start=\"12041\" data-end=\"12099\">Une contribution \u00e0 la lutte mondiale contre la torture<\/h3>\n<p data-start=\"12101\" data-end=\"12334\">\u00c0 travers cette contribution, la <strong data-start=\"12134\" data-end=\"12236\">Commission nationale des droits de l\u2019homme du Liban et son Comit\u00e9 pour la pr\u00e9vention de la torture<\/strong> r\u00e9affirment leur engagement \u00e0 soutenir le syst\u00e8me international de pr\u00e9vention \u00e9tabli par l\u2019OPCAT.<\/p>\n<p data-start=\"12336\" data-end=\"12629\">En participant \u00e0 l\u2019\u00e9laboration d\u2019orientations interpr\u00e9tatives faisant autorit\u00e9 sur l\u2019article 4, la Commission entend <strong data-start=\"12453\" data-end=\"12628\">renforcer les m\u00e9canismes de contr\u00f4le pr\u00e9ventif \u00e0 l\u2019\u00e9chelle mondiale et promouvoir une compr\u00e9hension globale des lieux o\u00f9 les personnes peuvent \u00eatre priv\u00e9es de leur libert\u00e9<\/strong>.<\/p>\n<p data-start=\"12631\" data-end=\"12855\">La Commission souligne que <strong data-start=\"12658\" data-end=\"12854\">la pr\u00e9vention efficace de la torture exige non seulement des cadres juridiques solides, mais aussi une surveillance ind\u00e9pendante, des ressources ad\u00e9quates et des mandats institutionnels clairs<\/strong>.<\/p>\n<p data-start=\"12857\" data-end=\"13080\">Garantir que les m\u00e9canismes de pr\u00e9vention puissent acc\u00e9der \u00e0 tous les lieux de d\u00e9tention pertinents, sans restriction, demeure essentiel pour <strong
