Une telle d\u00e9marche constituerait une \u00e9tape l\u00e9gislative d\u00e9cisive pour renforcer la protection du droit \u00e0 la vie et consolider l\u2019engagement du Liban envers les normes internationales relatives aux droits humains.<\/p>\n<p data-start=\"3338\" data-end=\"4137\">Cet appel intervient \u00e0 la lumi\u00e8re des progr\u00e8s r\u00e9alis\u00e9s par la proposition de loi visant \u00e0 abolir la peine de mort au Liban, apr\u00e8s qu\u2019elle a \u00e9t\u00e9 examin\u00e9e par la Commission parlementaire des droits de l\u2019homme et approuv\u00e9e avec certaines modifications, en vue de sa transmission \u00e0 l\u2019Assembl\u00e9e g\u00e9n\u00e9rale du Parlement pour un vote. Le Conseil des ministres a examin\u00e9 la proposition de loi lors de sa s\u00e9ance du 20 novembre 2025 et a publi\u00e9 un avis \u00e9crit d\u00e9taill\u00e9 de quatre pages exprimant son soutien total \u00e0 la proposition, accompagn\u00e9 de deux notes \u00e9mises par le minist\u00e8re de la Justice et le minist\u00e8re des Affaires sociales. C\u2019est la premi\u00e8re fois qu\u2019un projet d\u2019abolition de la peine de mort est pr\u00e9sent\u00e9 de mani\u00e8re aussi claire au Conseil des ministres et qu\u2019il b\u00e9n\u00e9ficie d\u2019un soutien officiel d\u00e9clar\u00e9.<\/p>\n<p data-start=\"4139\" data-end=\"4712\">La Commission souligne \u00e9galement que le Liban n\u2019a proc\u00e9d\u00e9 \u00e0 aucune ex\u00e9cution depuis le 17 janvier 2004, ce qui signifie que le pays vit effectivement depuis plus de vingt-deux ans sous un moratoire de facto sur l\u2019application de cette peine. Les donn\u00e9es internationales r\u00e9centes indiquent \u00e9galement<\/p>\n<p data-start=\"4139\" data-end=\"4712\">Le rapport intitul\u00e9 <a href=\"https:\/\/nhrclb.org\/wp-content\/uploads\/2026\/03\/Total-Number-of-Prisoners-Lebanon-2025.pdf\" target=\"_blank\" rel=\"noopener\"><em data-start=\"20\" data-end=\"122\">\u00ab R\u00e9partition des d\u00e9tenus actuels selon la dur\u00e9e de la peine, la cat\u00e9gorie et le type d\u2019infraction \u00bb<\/em><\/a> (date d\u2019impression : 27 janvier 2026), publi\u00e9 par la Direction des prisons du minist\u00e8re de la Justice, indique que 85 d\u00e9tenus \u00e9taient condamn\u00e9s \u00e0 mort \u00e0 la fin de l\u2019ann\u00e9e 2025. qu\u2019aucune ex\u00e9cution n\u2019a \u00e9t\u00e9 enregistr\u00e9e au Liban en 2025, tandis qu\u2019au moins deux nouvelles condamnations \u00e0 mort ont \u00e9t\u00e9 prononc\u00e9es en 2024.<a href=\"https:\/\/www.ecpm.org\/app\/uploads\/2025\/10\/INFOGRAPHIE_Liban_2024_FR.pdf\" target=\"_blank\" rel=\"noopener\"> D&rsquo;apr\u00e8s des donn\u00e9es r\u00e9centes publi\u00e9es par la coalition Ensemble contre la peine de mort (ECPM), en collaboration avec l&rsquo;Association libanaise pour les droits civiques (LACR) et l&rsquo;Association Justice et Mis\u00e9ricorde (AJEM),<\/a> le nombre de personnes condamn\u00e9es \u00e0 mort au Liban a atteint 84 fin 2024, dont au moins une femme. Des cas ont \u00e9galement \u00e9t\u00e9 recens\u00e9s indiquant que certaines de ces personnes ont subi des conditions pouvant s&rsquo;apparenter \u00e0 des mauvais traitements, notamment une d\u00e9t\u00e9rioration de leur sant\u00e9 mentale et physique et des tentatives de suicide r\u00e9p\u00e9t\u00e9es. Ces chiffres illustrent la complexit\u00e9 de la peine de mort, non seulement comme ch\u00e2timent extr\u00eame, mais aussi comme forme de d\u00e9tention prolong\u00e9e dans des conditions inhumaines.<\/p>\n<p data-start=\"4714\" data-end=\"5966\">La Commission estime que le maintien de la peine de mort dans les textes juridiques malgr\u00e9 son absence d\u2019application cr\u00e9e une contradiction entre la l\u00e9gislation et la pratique et laisse des dizaines de personnes sous le poids d\u2019une peine irr\u00e9versible. Cela n\u00e9cessite une solution l\u00e9gislative claire consistant \u00e0 l\u2019abolir et \u00e0 la remplacer par les peines imm\u00e9diatement inf\u00e9rieures. L\u2019usage de la peine de mort est incompatible avec le droit \u00e0 la vie ainsi qu\u2019avec le droit de vivre \u00e0 l\u2019abri de la torture ou de traitements ou peines cruels, inhumains ou d\u00e9gradants. Un consensus mondial croissant se d\u00e9gage en faveur de l\u2019abolition de la peine de mort. Environ 170 pays ont aboli la peine de mort ou cess\u00e9 de l\u2019appliquer, que ce soit dans la loi ou dans la pratique. Toutefois, malgr\u00e9 cette tendance mondiale \u00e0 l\u2019abolition, elle demeure utilis\u00e9e dans un nombre limit\u00e9 de pays, en grande partie en raison du mythe persistant selon lequel elle aurait un effet dissuasif sur la criminalit\u00e9. Un petit nombre d\u2019\u00c9tats autorisent encore \u00e9galement le recours \u00e0 la peine de mort pour des infractions autres que les crimes les plus graves impliquant un homicide intentionnel, y compris les infractions li\u00e9es aux stup\u00e9fiants ou certaines accusations de terrorisme.<\/p>\n<p data-start=\"4765\" data-end=\"4799\"><strong data-start=\"4765\" data-end=\"4799\">Texte de la proposition de loi<\/strong><\/p>\n<p data-start=\"4801\" data-end=\"4902\">La proposition de loi visant \u00e0 abolir la peine de mort au Liban comprend les dispositions suivantes :<\/p>\n<p data-start=\"4904\" data-end=\"5070\"><strong data-start=\"4904\" data-end=\"4919\">Article 1 :<\/strong><br data-start=\"4919\" data-end=\"4922\" \/>La peine de mort est abolie partout o\u00f9 elle appara\u00eet, notamment dans le Code p\u00e9nal, et est remplac\u00e9e par la peine maximale imm\u00e9diatement inf\u00e9rieure.<\/p>\n<p data-start=\"5072\" data-end=\"5332\"><strong data-start=\"5072\" data-end=\"5087\">Article 2 :<\/strong><br data-start=\"5087\" data-end=\"5090\" \/>Les personnes condamn\u00e9es \u00e0 mort avant l\u2019entr\u00e9e en vigueur de la pr\u00e9sente loi b\u00e9n\u00e9ficieront de ses dispositions, avec la possibilit\u00e9 de b\u00e9n\u00e9ficier de la loi sur l\u2019ex\u00e9cution des peines n\u00b0 463\/2002 et de ses modifications par la loi n\u00b0 183\/2011.<\/p>\n<p data-start=\"5334\" data-end=\"5440\"><strong data-start=\"5334\" data-end=\"5349\">Article 3 :<\/strong><br data-start=\"5349\" data-end=\"5352\" \/>La pr\u00e9sente loi entre en vigueur imm\u00e9diatement apr\u00e8s sa publication au Journal officiel.<\/p>\n<p data-start=\"5442\" data-end=\"5520\"><strong data-start=\"5442\" data-end=\"5520\">Modification adopt\u00e9e par la Commission parlementaire des droits de l\u2019homme<\/strong><\/p>\n<p data-start=\"5522\" data-end=\"5712\">La Commission parlementaire des droits de l\u2019homme a approuv\u00e9 l\u2019ajout d\u2019un amendement proc\u00e9dural concernant les personnes condamn\u00e9es \u00e0 mort avant l\u2019adoption de la loi, stipulant ce qui suit :<\/p>\n<p data-start=\"5714\" data-end=\"6041\">\u00ab Si une personne condamn\u00e9e \u00e0 mort pr\u00e9sente une demande de r\u00e9duction de sa peine et que la famille de la victime s\u2019y oppose, la Commission de r\u00e9duction des peines reporte l\u2019examen de la demande pour une p\u00e9riode de deux ans, une seule fois, m\u00eame si la personne condamn\u00e9e a vers\u00e9 les indemnit\u00e9s dues \u00e0 la famille de la victime. \u00bb<\/p>\n<h1 data-start=\"6048\" data-end=\"6060\"><strong data-start=\"6048\" data-end=\"6060\">Contexte<\/strong><\/h1>\n<p data-start=\"6062\" data-end=\"6714\">L\u2019<strong data-start=\"6064\" data-end=\"6113\">Organisation libanaise pour les droits civils<\/strong> a propos\u00e9 une nouvelle loi visant \u00e0 abolir la peine de mort et l\u2019a soumise au Parlement le 7 octobre 2025. Elle a \u00e9t\u00e9 enregistr\u00e9e sous le num\u00e9ro 160\/2025 et sign\u00e9e par sept d\u00e9put\u00e9s appartenant \u00e0 diff\u00e9rents blocs parlementaires (Elias Hankach, Osama Saad Al-Masri, Paula Yacoubian, Georges Okais, Faisal Sayegh, Halima Kaakour et Michel Doueihi). L\u2019organisation a nomm\u00e9 la proposition <strong data-start=\"6498\" data-end=\"6522\">\u00ab Loi Walid Slaibi \u00bb<\/strong>, en hommage au penseur non-violent d\u00e9funt Walid Slaibi, pionnier de la campagne nationale pour l\u2019abolition de la peine de mort au Liban depuis 1997, en partenariat avec la Dre Ougarit Younan.<\/p>\n<p data-start=\"6716\" data-end=\"6992\">L\u2019expos\u00e9 des motifs de la proposition repose sur plusieurs consid\u00e9rations, dont la n\u00e9cessit\u00e9 d\u2019\u00ab humaniser les peines \u00bb dans le cadre d\u2019une responsabilit\u00e9 civilisationnelle li\u00e9e au progr\u00e8s des nations. Plus pr\u00e9cis\u00e9ment, l\u2019expos\u00e9 des motifs met en avant les \u00e9l\u00e9ments suivants :<\/p>\n<ul data-start=\"6994\" data-end=\"8235\">\n<li data-start=\"6994\" data-end=\"7389\">\n<p data-start=\"6996\" data-end=\"7389\">L\u2019adh\u00e9sion du Liban, au niveau international, au camp des \u00c9tats oppos\u00e9s \u00e0 la peine de mort, apr\u00e8s la signature \u00e0 l\u2019ONU de la r\u00e9solution 62\/194 adopt\u00e9e en 2007 concernant un <strong data-start=\"7169\" data-end=\"7220\">moratoire sur l\u2019application de la peine de mort<\/strong>, ainsi que son vote en faveur de cette r\u00e9solution \u00e0 trois reprises cons\u00e9cutives en 2020, 2022 et 2024, ce qui refl\u00e8te une volont\u00e9 claire de rejeter la peine capitale.<\/p>\n<\/li>\n<li data-start=\"7390\" data-end=\"7813\">\n<p data-start=\"7392\" data-end=\"7813\">Le passage de <strong data-start=\"7406\" data-end=\"7453\">21 ann\u00e9es sans aucune ex\u00e9cution (2004-2025)<\/strong>, ce qui d\u00e9montre que l\u2019\u00c9tat libanais, malgr\u00e9 des circonstances g\u00e9n\u00e9rales difficiles et \u00e0 travers diff\u00e9rents mandats, a constamment \u00e9vit\u00e9 de proc\u00e9der \u00e0 des ex\u00e9cutions. Cela place le Liban parmi les pays ayant aboli la peine de mort en pratique selon les normes internationales, puisqu\u2019aucune ex\u00e9cution n\u2019a \u00e9t\u00e9 r\u00e9alis\u00e9e depuis plus de dix ann\u00e9es cons\u00e9cutives.<\/p>\n<\/li>\n<li data-start=\"7814\" data-end=\"8235\">\n<p data-start=\"7816\" data-end=\"8235\">L\u2019abrogation en 2001 de la loi 302\/94, connue sous le nom de <strong data-start=\"7877\" data-end=\"7897\">\u00ab loi du tueur \u00bb<\/strong>, obtenue par un vote remarquable au Parlement (94 %), marquant le d\u00e9but du parcours juridique d\u2019opposition \u00e0 la peine de mort, suivi depuis 2004 par une volont\u00e9 constante de ne pas appliquer les condamnations \u00e0 mort jusqu\u2019\u00e0 aujourd\u2019hui. Ainsi, l\u2019orientation actuelle au Liban refl\u00e8te une position durable visant \u00e0 r\u00e9examiner cette peine.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"8237\" data-end=\"9002\">L\u2019expos\u00e9 des motifs mentionne \u00e9galement d\u2019autres obligations, notamment le fait que le Liban est membre fondateur du syst\u00e8me international des droits humains et partie \u00e0 plusieurs instruments et conventions mondiaux et r\u00e9gionaux soutenant le droit \u00e0 la vie, tels que la <strong data-start=\"8507\" data-end=\"8556\">D\u00e9claration universelle des droits de l\u2019homme<\/strong>, devenue partie int\u00e9grante du pr\u00e9ambule de la Constitution libanaise et donc contraignante pour le Liban. S\u2019ajoutent le <strong data-start=\"8677\" data-end=\"8740\">Pacte international relatif aux droits civils et politiques<\/strong>, en particulier son deuxi\u00e8me protocole facultatif visant \u00e0 abolir la peine de mort (\u00e0 noter que le Liban ne l\u2019a pas encore ratifi\u00e9), ainsi que la <strong data-start=\"8887\" data-end=\"8933\">Convention relative aux droits de l\u2019enfant<\/strong>, la <strong data-start=\"8938\" data-end=\"8976\">Charte arabe des droits de l\u2019homme<\/strong>, et d\u2019autres instruments.<\/p>\n<p data-start=\"9004\" data-end=\"9618\">Enfin, l\u2019expos\u00e9 des motifs souligne la n\u00e9cessit\u00e9 de traiter en priorit\u00e9 les causes profondes de la criminalit\u00e9 en d\u00e9veloppant des politiques de pr\u00e9vention visant \u00e0 r\u00e9duire les crimes, puisqu\u2019il a \u00e9t\u00e9 d\u00e9montr\u00e9 qu\u2019il n\u2019existe aucun lien entre l\u2019application de la peine de mort et la dissuasion du crime.
