{"id":4433,"date":"2026-03-01T13:10:22","date_gmt":"2026-03-01T11:10:22","guid":{"rendered":"https:\/\/nhrclb.org\/archives\/4433"},"modified":"2026-03-01T13:12:50","modified_gmt":"2026-03-01T11:12:50","slug":"nhris-step-into-the-spotlight-as-un-process-on-older-persons-rights-begins-in-geneva","status":"publish","type":"post","link":"https:\/\/nhrclb.org\/fr\/archives\/4433","title":{"rendered":"Les institutions nationales des droits de l\u2019homme au c\u0153ur du lancement du processus onusien sur les droits des personnes \u00e2g\u00e9es"},"content":{"rendered":"<p data-start=\"0\" data-end=\"425\">Dans un d\u00e9veloppement attendu depuis des d\u00e9cennies, la premi\u00e8re r\u00e9union organisationnelle du Groupe de travail intergouvernemental \u00e0 composition non limit\u00e9e sur les droits humains des personnes \u00e2g\u00e9es s\u2019est tenue au Palais des Nations \u00e0 Gen\u00e8ve, lan\u00e7ant officiellement le processus d\u2019\u00e9laboration d\u2019un instrument international juridiquement contraignant consacr\u00e9 \u00e0 la protection et \u00e0 la promotion des droits des personnes \u00e2g\u00e9es.<\/p>\n<p data-start=\"427\" data-end=\"886\">La r\u00e9union ne s\u2019est pas conclue par un accord sur un cadre proc\u00e9dural. Toutefois, loin de signaler une stagnation, elle a marqu\u00e9 une ouverture d\u00e9cisive des n\u00e9gociations, cr\u00e9\u00e9 un espace de dialogue substantiel et pr\u00e9par\u00e9 la voie \u00e0 des contributions \u00e9crites ainsi qu\u2019\u00e0 la reprise des discussions durant l\u2019\u00e9t\u00e9. Pour les Institutions nationales des droits de l\u2019homme, il ne s\u2019agissait pas simplement d\u2019un moment d\u2019observation, mais d\u2019une opportunit\u00e9 d\u00e9terminante.<\/p>\n<h3 data-start=\"888\" data-end=\"938\">Une nouvelle phase dans la protection mondiale<\/h3>\n<p data-start=\"940\" data-end=\"1451\">Cr\u00e9\u00e9 par la r\u00e9solution 58\/13 du Conseil des droits de l\u2019homme des Nations Unies en avril 2025, le Groupe de travail intergouvernemental repr\u00e9sente l\u2019aboutissement d\u2019ann\u00e9es de plaidoyer soutenu men\u00e9 par des organisations de la soci\u00e9t\u00e9 civile, des experts ind\u00e9pendants et des Institutions nationales des droits de l\u2019homme \u00e0 travers le monde. La r\u00e9solution reconna\u00eet explicitement les INDH comme des parties prenantes essentielles et les appelle \u00e0 contribuer \u00ab activement et de mani\u00e8re constructive \u00bb au processus.<\/p>\n<p data-start=\"1453\" data-end=\"1513\">Cette reconnaissance s\u2019est concr\u00e8tement manifest\u00e9e \u00e0 Gen\u00e8ve.<\/p>\n<p data-start=\"1515\" data-end=\"1870\">L\u2019Alliance mondiale des institutions nationales des droits de l\u2019homme a particip\u00e9 aux c\u00f4t\u00e9s de plusieurs de ses institutions membres et de repr\u00e9sentants de son Groupe de travail sur les droits des personnes \u00e2g\u00e9es. Leur message \u00e9tait clair, les INDH occupent une position unique \u00e0 l\u2019intersection des \u00c9tats, de la soci\u00e9t\u00e9 civile et des titulaires de droits.<\/p>\n<p data-start=\"1872\" data-end=\"2322\">Op\u00e9rant au sein des syst\u00e8mes juridiques nationaux tout en maintenant leur ind\u00e9pendance conform\u00e9ment aux Principes de Paris, les INDH r\u00e9unissent une combinaison rare de proximit\u00e9 avec les personnes \u00e2g\u00e9es et d\u2019autorit\u00e9 institutionnelle. Elles traduisent les exp\u00e9riences v\u00e9cues en recommandations politiques, identifient les lacunes en mati\u00e8re de mise en \u0153uvre et veillent \u00e0 ce que les engagements abstraits soient ancr\u00e9s dans les r\u00e9alit\u00e9s quotidiennes.<\/p>\n<h3 data-start=\"2324\" data-end=\"2397\">Participation, responsabilit\u00e9 et comblement des lacunes de protection<\/h3>\n<p data-start=\"2399\" data-end=\"2748\">Tout au long de la session, les \u00c9tats membres et la Pr\u00e9sidence ont soulign\u00e9 la n\u00e9cessit\u00e9 d\u2019une participation significative des personnes \u00e2g\u00e9es, des organisations de la soci\u00e9t\u00e9 civile et des INDH. Cet accent mis sur l\u2019inclusivit\u00e9 refl\u00e8te une compr\u00e9hension plus large selon laquelle la l\u00e9gitimit\u00e9 et l\u2019efficacit\u00e9 d\u00e9pendent d\u2019un engagement authentique.<\/p>\n<p data-start=\"2750\" data-end=\"3137\">Des INDH de Gr\u00e8ce, du Guatemala, du Nig\u00e9ria, d\u2019Afrique du Sud et d\u2019Ouganda ont pr\u00e9sent\u00e9 des interventions mettant en lumi\u00e8re des lacunes persistantes en mati\u00e8re de protection, la discrimination fond\u00e9e sur l\u2019\u00e2ge et les obstacles \u00e0 l\u2019acc\u00e8s \u00e0 la justice. Leurs contributions se sont articul\u00e9es autour de trois piliers interd\u00e9pendants, la participation, la responsabilit\u00e9 et l\u2019applicabilit\u00e9.<\/p>\n<p data-start=\"3139\" data-end=\"3553\">Lors d\u2019une table ronde consacr\u00e9e aux \u00e9l\u00e9ments d\u2019un futur trait\u00e9, la Commissaire Beda Angeles Epres de la Commission des droits de l\u2019homme des Philippines a propos\u00e9 que le nouvel instrument habilite formellement les INDH en tant que m\u00e9canismes nationaux de suivi. Elle a \u00e9galement plaid\u00e9 pour l\u2019inclusion d\u2019un m\u00e9canisme de plainte individuelle et pour un renforcement des dispositions relatives \u00e0 la responsabilit\u00e9.<\/p>\n<p data-start=\"3555\" data-end=\"3993\">Ces propositions refl\u00e8tent un consensus croissant parmi les acteurs des droits humains selon lequel les droits des personnes \u00e2g\u00e9es ne peuvent plus demeurer fragment\u00e9s \u00e0 travers les cadres existants. Un instrument d\u00e9di\u00e9 et complet est n\u00e9cessaire pour traiter l\u2019\u00e2gisme syst\u00e9mique, l\u2019exclusion sociale, l\u2019insuffisance de la protection sociale ainsi que la discrimination dans les domaines de la sant\u00e9, du logement et de l\u2019acc\u00e8s \u00e0 la justice.<\/p>\n<h3 data-start=\"3995\" data-end=\"4040\">La perspective d\u2019une experte ind\u00e9pendante<\/h3>\n<p data-start=\"4042\" data-end=\"4441\">Claudia Mahler, Experte ind\u00e9pendante sur la jouissance de tous les droits humains par les personnes \u00e2g\u00e9es, a offert une r\u00e9flexion franche \u00e0 l\u2019issue de la session. Elle a salu\u00e9 la participation visible des INDH de toutes les r\u00e9gions, soulignant que leurs mandats, leur exp\u00e9rience au niveau national et leur proximit\u00e9 avec les titulaires de droits les rendent indispensables au processus de r\u00e9daction.<\/p>\n<p data-start=\"4443\" data-end=\"4705\">Ses remarques ont mis en \u00e9vidence un point fondamental, le processus d\u2019\u00e9laboration d\u2019un trait\u00e9 ne consiste pas uniquement \u00e0 n\u00e9gocier un texte. Il s\u2019agit de red\u00e9finir la mani\u00e8re dont les soci\u00e9t\u00e9s per\u00e7oivent le vieillissement, la dignit\u00e9, l\u2019autonomie et l\u2019\u00e9galit\u00e9.<\/p>\n<h3 data-start=\"4707\" data-end=\"4734\">Vers juillet et octobre<\/h3>\n<p data-start=\"4736\" data-end=\"5089\">Bien que les d\u00e9l\u00e9gations n\u2019aient pas finalis\u00e9 de cadre proc\u00e9dural, la Pr\u00e9sidence a confirm\u00e9 que le processus s\u2019ouvrira prochainement aux contributions \u00e9crites. Les \u00c9tats membres, les INDH, les organisations de la soci\u00e9t\u00e9 civile et les autres parties prenantes seront invit\u00e9s \u00e0 soumettre des propositions, garantissant ainsi la poursuite de la dynamique.<\/p>\n<p data-start=\"5091\" data-end=\"5282\">Deux sessions substantielles sont pr\u00e9vues en juillet et en octobre 2026. Ces r\u00e9unions d\u00e9passeront les questions organisationnelles pour aborder le contenu fondamental de l\u2019instrument propos\u00e9.<\/p>\n<p data-start=\"5284\" data-end=\"5534\">La transparence, l\u2019inclusivit\u00e9 et l\u2019accessibilit\u00e9 seront essentielles \u00e0 chaque \u00e9tape. La participation significative des personnes \u00e2g\u00e9es elles-m\u00eames, ainsi que de leurs organisations repr\u00e9sentatives, demeure centrale pour la cr\u00e9dibilit\u00e9 du processus.<\/p>\n<h3 data-start=\"5536\" data-end=\"5577\">Une participation coordonn\u00e9e des INDH<\/h3>\n<p data-start=\"5579\" data-end=\"5952\">Afin de soutenir une participation structur\u00e9e et durable, l\u2019Alliance mondiale a \u00e9labor\u00e9 une strat\u00e9gie d\u00e9di\u00e9e \u00e0 l\u2019engagement aupr\u00e8s du Groupe de travail. Cette approche combine un large partage d\u2019informations et le renforcement des capacit\u00e9s avec un engagement plus approfondi pour les institutions pr\u00eates \u00e0 fournir des contributions juridiques et politiques substantielles.<\/p>\n<p data-start=\"5954\" data-end=\"6067\">Ce mod\u00e8le \u00e0 deux niveaux reconna\u00eet la diversit\u00e9 des capacit\u00e9s des INDH tout en assurant une coh\u00e9rence collective.<\/p>\n<h3 data-start=\"6069\" data-end=\"6093\">Un moment historique<\/h3>\n<p data-start=\"6095\" data-end=\"6333\">Pendant des d\u00e9cennies, les droits des personnes \u00e2g\u00e9es ont souvent \u00e9t\u00e9 consid\u00e9r\u00e9s comme implicites dans les trait\u00e9s existants relatifs aux droits humains. La r\u00e9union de Gen\u00e8ve marque un passage de l\u2019implicite \u00e0 la reconnaissance explicite.<\/p>\n<p data-start=\"6335\" data-end=\"6513\">Si l\u2019accord proc\u00e9dural reste en suspens, la session organisationnelle a confirm\u00e9 que le processus est en marche, que les parties prenantes sont mobilis\u00e9es et que l\u2019\u00e9lan est r\u00e9el.<\/p>\n<p data-start=\"6515\" data-end=\"6937\">Pour les INDH, le message est tout aussi clair. Leurs mandats nationaux, leurs pouvoirs d\u2019enqu\u00eate, leurs r\u00f4les de suivi et leur proximit\u00e9 avec les communaut\u00e9s les placent au c\u0153ur de cette architecture en \u00e9volution. \u00c0 mesure que le Groupe de travail intergouvernemental avance, leurs contributions fa\u00e7onneront non seulement le texte d\u2019un trait\u00e9, mais aussi l\u2019avenir d\u2019un vieillissement dans la dignit\u00e9 \u00e0 l\u2019\u00e9chelle mondiale.<\/p>\n<h3 data-start=\"6939\" data-end=\"6951\">Contexte<\/h3>\n<p data-start=\"6953\" data-end=\"7403\" data-is-last-node=\"\" data-is-only-node=\"\">\u00c9tabli par la r\u00e9solution 58\/13 du Conseil des droits de l\u2019homme en avril 2025, le Groupe de travail intergouvernemental \u00e0 composition non limit\u00e9e repr\u00e9sente l\u2019aboutissement de d\u00e9cennies de plaidoyer men\u00e9 par la soci\u00e9t\u00e9 civile, des experts ind\u00e9pendants et des INDH.
