Nabih Berri, conform\u00e9ment \u00e0 l\u2019article 124 du R\u00e8glement int\u00e9rieur du Parlement.<\/a> Cette question porte sur l\u2019absence persistante de d\u00e9crets fixant les indemnit\u00e9s financi\u00e8res de l\u2019Institution nationale des droits de l\u2019homme, y compris le M\u00e9canisme national de pr\u00e9vention de la torture, ainsi que de la Commission nationale des personnes disparues et victimes de disparition forc\u00e9e.<\/p>\n<p data-start=\"7491\" data-end=\"7847\">Cette initiative intervient alors que neuf ans se sont \u00e9coul\u00e9s depuis l\u2019adoption de la loi n\u00b0 62\/2016 cr\u00e9ant l\u2019Institution nationale des droits de l\u2019homme, et sept ans depuis la loi n\u00b0 105\/2018 relative aux personnes disparues et disparues de force, sans que ces textes ne soient pleinement mis en \u0153uvre par l\u2019adoption des d\u00e9crets ex\u00e9cutifs indispensables.<\/p>\n<p data-start=\"7849\" data-end=\"7903\"><strong data-start=\"7849\" data-end=\"7903\">Premi\u00e8rement, le cadre juridique et institutionnel<\/strong><\/p>\n<p data-start=\"7905\" data-end=\"8235\">Les d\u00e9put\u00e9s ont rappel\u00e9 que l\u2019Institution nationale des droits de l\u2019homme a \u00e9t\u00e9 cr\u00e9\u00e9e par la loi n\u00b0 62\/2016 et constitu\u00e9e par des d\u00e9crets adopt\u00e9s en 2018 et 2019, tandis que la Commission nationale des personnes disparues et disparues de force a \u00e9t\u00e9 cr\u00e9\u00e9e par la loi n\u00b0 105\/2018 et constitu\u00e9e par le d\u00e9cret n\u00b0 973 du 27 ao\u00fbt 2025.<\/p>\n<p data-start=\"8237\" data-end=\"8781\">Ils ont soulign\u00e9 que les deux lois pr\u00e9voient express\u00e9ment que les indemnit\u00e9s et compensations des pr\u00e9sidents et des membres de ces instances soient fix\u00e9es par des d\u00e9crets adopt\u00e9s en Conseil des ministres, sur proposition des ministres comp\u00e9tents. Des projets de d\u00e9crets ont \u00e9t\u00e9 pr\u00e9par\u00e9s par le minist\u00e8re de la Justice, ont fait l\u2019objet de plusieurs avis consultatifs du Conseil d\u2019\u00c9tat et ont \u00e9t\u00e9 transmis au minist\u00e8re des Finances sous diff\u00e9rents gouvernements, sans jamais \u00eatre soumis, selon les r\u00e8gles, au Conseil des ministres pour adoption.<\/p>\n<p data-start=\"8783\" data-end=\"8905\"><strong data-start=\"8783\" data-end=\"8905\">Deuxi\u00e8mement, les motifs justifiant l\u2019adoption du d\u00e9cret d\u2019indemnit\u00e9s de l\u2019Institution nationale des droits de l\u2019homme<\/strong><\/p>\n<p data-start=\"8907\" data-end=\"9483\">Les d\u00e9put\u00e9s ont insist\u00e9 sur le fait que le blocage prolong\u00e9 du d\u00e9cret d\u2019indemnit\u00e9s porte atteinte \u00e0 l\u2019ind\u00e9pendance de l\u2019Institution nationale des droits de l\u2019homme et affaiblit sa capacit\u00e9 \u00e0 remplir ses missions essentielles, notamment le suivi, la r\u00e9ception des plaintes, l\u2019enqu\u00eate sur les violations et la pr\u00e9vention de la torture. Ils ont rappel\u00e9 que le principe du plein temps pour une dur\u00e9e de six ans, pr\u00e9vu par la loi, implique n\u00e9cessairement l\u2019octroi d\u2019indemnit\u00e9s claires et \u00e9quitables permettant aux membres nomm\u00e9s de prendre une d\u00e9cision professionnelle responsable.<\/p>\n<p data-start=\"9485\" data-end=\"10072\">Ils ont \u00e9galement rappel\u00e9 que les Principes de Paris exigent un financement ad\u00e9quat pour garantir l\u2019ind\u00e9pendance des institutions nationales des droits de l\u2019homme, et que le Sous-Comit\u00e9 d\u2019accr\u00e9ditation de l\u2019Alliance mondiale des institutions nationales des droits de l\u2019homme l\u2019a confirm\u00e9 \u00e0 plusieurs reprises depuis 2000. Ils ont enfin soulign\u00e9 que l\u2019Institution a d\u00e9pos\u00e9 une demande d\u2019accr\u00e9ditation internationale (GANHRI), ce qui rend l\u2019adoption du d\u00e9cret d\u2019indemnit\u00e9s urgente et incontournable, d\u2019autant plus que ses r\u00e8glements int\u00e9rieur et financier ont \u00e9t\u00e9 adopt\u00e9s en novembre 2025.<\/p>\n<p data-start=\"10074\" data-end=\"10211\"><strong data-start=\"10074\" data-end=\"10211\">Troisi\u00e8mement, les motifs justifiant l\u2019adoption du d\u00e9cret d\u2019indemnit\u00e9s de la Commission des personnes disparues et disparues de force<\/strong><\/p>\n<p data-start=\"10213\" data-end=\"11072\">Les d\u00e9put\u00e9s ont rappel\u00e9 que la loi n\u00b0 105\/2018 constitue un cadre juridique national avanc\u00e9 consacrant le droit des familles \u00e0 conna\u00eetre le sort de leurs proches et cr\u00e9ant une instance ind\u00e9pendante charg\u00e9e de missions hautement sensibles sur les plans humanitaire, juridique, technique et \u00e9thique. Ils ont soulign\u00e9 que le pr\u00e9sident de la Commission est l\u00e9galement tenu \u00e0 un engagement \u00e0 plein temps et interdit d\u2019exercer toute autre activit\u00e9 professionnelle, ce qui impose l\u2019adoption d\u2019une indemnit\u00e9 mensuelle forfaitaire \u00e9quitable. Ils ont \u00e9galement rappel\u00e9 que les membres de la Commission, experts reconnus dans les domaines du droit, de la m\u00e9decine, de la m\u00e9decine l\u00e9gale, du monde acad\u00e9mique et des droits humains, consacrent un temps et un effort consid\u00e9rables \u00e0 des travaux exigeants, justifiant l\u2019octroi d\u2019indemnit\u00e9s pour la participation aux s\u00e9ances.<\/p>\n<p data-start=\"11074\" data-end=\"11475\">Ils ont averti que l\u2019absence d\u2019application de l\u2019article 25 de la loi et le non-\u00e9mission du d\u00e9cret correspondant vident le texte l\u00e9gal de sa port\u00e9e ex\u00e9cutive, entravent le fonctionnement r\u00e9gulier de la Commission et contreviennent aux principes de l\u2019\u00c9tat de droit ainsi qu\u2019aux obligations constitutionnelles et internationales du Liban \u00e0 l\u2019\u00e9gard des victimes de disparition forc\u00e9e et de leurs familles.<\/p>\n<p data-start=\"11477\" data-end=\"11549\"><strong data-start=\"11477\" data-end=\"11549\">Quatri\u00e8mement, les contradictions dans l\u2019orientation gouvernementale<\/strong><\/p>\n<p data-start=\"11551\" data-end=\"11989\">Les d\u00e9put\u00e9s ont mis en \u00e9vidence une contradiction manifeste dans l\u2019orientation gouvernementale, rappelant que le Conseil des ministres a adopt\u00e9 en 2025 plusieurs d\u00e9crets augmentant de mani\u00e8re substantielle les indemnit\u00e9s des pr\u00e9sidents et des membres de diverses autorit\u00e9s de r\u00e9gulation et conseils publics, notamment dans les secteurs des t\u00e9l\u00e9communications, de l\u2019\u00e9lectricit\u00e9, du d\u00e9veloppement et reconstruction, et de l\u2019aviation civile.<\/p>\n<p data-start=\"11991\" data-end=\"12504\">Ils ont soulign\u00e9 que ces d\u00e9crets ont port\u00e9 les indemnit\u00e9s mensuelles \u00e0 des centaines de millions de livres libanaises, parfois \u00e0 plus de cent fois le salaire de base d\u2019un fonctionnaire de premi\u00e8re cat\u00e9gorie, tandis que les instances charg\u00e9es des droits humains et des disparitions forc\u00e9es demeurent priv\u00e9es des garanties minimales d\u2019ind\u00e9pendance financi\u00e8re. Selon eux, cela refl\u00e8te une approche persistante consid\u00e9rant ces instances comme des structures symboliques plut\u00f4t que comme des institutions essentielles.<\/p>\n<p data-start=\"12506\" data-end=\"12564\"><strong data-start=\"12506\" data-end=\"12564\">Cinqui\u00e8mement, le contenu de la question parlementaire<\/strong><\/p>\n<p data-start=\"12566\" data-end=\"13025\">Les d\u00e9put\u00e9s ont demand\u00e9 au gouvernement de fournir des r\u00e9ponses claires quant aux raisons de la non-application persistante de l\u2019article 30 de la loi n\u00b0 62\/2016 et de l\u2019article 25 de la loi n\u00b0 105\/2018, \u00e0 l\u2019absence d\u2019inscriptions budg\u00e9taires dans le budget 2026 pour couvrir les indemnit\u00e9s concern\u00e9es, et \u00e0 l\u2019intention ou non d\u2019adopter les m\u00eames crit\u00e8res que ceux appliqu\u00e9s aux autres autorit\u00e9s de r\u00e9gulation, ou d\u2019indiquer les crit\u00e8res alternatifs envisag\u00e9s.<\/p>\n<p data-start=\"13027\" data-end=\"13488\" data-is-last-node=\"\" data-is-only-node=\"\">Ils ont conclu en affirmant que l\u2019activation effective de ces deux instances par l\u2019adoption des d\u00e9crets d\u2019indemnit\u00e9s ne constitue pas une simple question administrative ou financi\u00e8re, mais un choix politique et juridique fondamental traduisant l\u2019engagement de l\u2019\u00c9tat libanais en faveur des droits humains, des droits des familles des personnes disparues et disparues de force, et du renforcement de la confiance entre les citoyens et les institutions publiques.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le 5 janvier 2026, les d\u00e9put\u00e9s Yassine Yassine, Mark Daou, Halimeh Kaakour, Melhem Khalaf, Michel Moussa et Bilal Abdallah ont adress\u00e9 une question parlementaire officielle au gouvernement libanais, par l\u2019interm\u00e9diaire du Pr\u00e9sident de la Chambre des d\u00e9put\u00e9s, M.
