La d\u00e9tention provisoire, qui est cens\u00e9e \u00eatre une mesure exceptionnelle et temporaire, se transforme dans de nombreux cas en une r\u00e9alit\u00e9 de longue dur\u00e9e, au cours de laquelle la dignit\u00e9 des personnes d\u00e9tenues est mise \u00e0 l\u2019\u00e9preuve, tout comme la capacit\u00e9 de l\u2019\u00c9tat \u00e0 respecter ses obligations juridiques et humanitaires.<\/p>\n<p data-start=\"564\" data-end=\"1305\">Dans ce contexte, la Commission nationale des droits de l\u2019homme, incluant le Comit\u00e9 pour la pr\u00e9vention de la torture, a men\u00e9 une s\u00e9rie de visites de terrain dans plusieurs postes des Forces de s\u00e9curit\u00e9 int\u00e9rieure et lieux de d\u00e9tention, r\u00e9partis dans diff\u00e9rentes r\u00e9gions, au cours de l\u2019ann\u00e9e 2025. Ces visites s\u2019inscrivaient dans le cadre d\u2019un projet soutenu par le Programme des Nations Unies pour le d\u00e9veloppement, visant \u00e0 surveiller les conditions de d\u00e9tention, \u00e0 fournir des consultations juridiques aux personnes d\u00e9tenues, et \u00e0 contribuer \u00e0 la r\u00e9duction de la surpopulation carc\u00e9rale par l\u2019activation des m\u00e9canismes juridiques disponibles, notamment les demandes de mise en libert\u00e9 pour les personnes remplissant les conditions l\u00e9gales.<\/p>\n<p data-start=\"1307\" data-end=\"2085\">Les visites de terrain effectu\u00e9es par la Commission nationale des droits de l\u2019homme, incluant le Comit\u00e9 pour la pr\u00e9vention de la torture, ont concern\u00e9 plusieurs postes et cellules de d\u00e9tention relevant des Forces de s\u00e9curit\u00e9 int\u00e9rieure dans diff\u00e9rentes zones. Elles ont couvert les centres suivants : le poste de Halba, la brigade judiciaire de Halba, le poste de Beino, le poste de Qobayat, la brigade de Chiyah, le poste de Brummana, ainsi que les centres de d\u00e9tention de Sofar et de Hammana r\u00e9serv\u00e9s aux mineurs. Le suivi a \u00e9galement inclus d\u2019autres centres lors de visites ult\u00e9rieures, dans le cadre d\u2019une approche progressive visant \u00e0 couvrir le plus grand nombre possible de lieux de d\u00e9tention, en fonction des priorit\u00e9s de suivi et des besoins humanitaires et juridiques.<\/p>\n<h3 data-start=\"2087\" data-end=\"2149\">Une m\u00e9thodologie fond\u00e9e sur l\u2019inspection et l\u2019intervention<\/h3>\n<p data-start=\"2151\" data-end=\"2669\">Ces visites se sont distingu\u00e9es par une approche duale combinant le suivi direct sur le terrain et l\u2019intervention juridique pratique. Elles ne se sont pas limit\u00e9es \u00e0 la documentation des conditions mat\u00e9rielles des cellules, en termes d\u2019espace, de propret\u00e9, de ventilation et de capacit\u00e9 d\u2019accueil, mais ont \u00e9galement inclus des entretiens individuels avec les personnes d\u00e9tenues, l\u2019examen des registres de d\u00e9tention, l\u2019analyse des dossiers judiciaires, et la v\u00e9rification de la l\u00e9galit\u00e9 et de la dur\u00e9e de la d\u00e9tention.<\/p>\n<p data-start=\"2671\" data-end=\"3148\">Lorsque cela \u00e9tait possible, des demandes de mise en libert\u00e9 ont \u00e9t\u00e9 pr\u00e9par\u00e9es, des consultations juridiques pr\u00e9liminaires ont \u00e9t\u00e9 fournies, et les proc\u00e9dures judiciaires ont \u00e9t\u00e9 expliqu\u00e9es aux personnes d\u00e9tenues, dont beaucoup manquent de connaissances juridiques ou des moyens financiers n\u00e9cessaires pour mandater des avocats. Cette approche a constitu\u00e9 un outil concret pour att\u00e9nuer la surpopulation, tout en renfor\u00e7ant la confiance des d\u00e9tenus dans le parcours judiciaire.<\/p>\n<h3 data-start=\"3150\" data-end=\"3235\">Des lieux de d\u00e9tention sous pression : la surpopulation comme d\u00e9nominateur commun<\/h3>\n<p data-start=\"3237\" data-end=\"3655\">Les diff\u00e9rentes visites ont montr\u00e9 que la surpopulation constitue le d\u00e9nominateur commun le plus marquant de la majorit\u00e9 des lieux de d\u00e9tention inspect\u00e9s. Dans plusieurs centres, le nombre de personnes d\u00e9tenues d\u00e9passait la capacit\u00e9 r\u00e9elle d\u2019accueil, dans des espaces exigus ne respectant pas les normes humanitaires minimales, obligeant les d\u00e9tenus \u00e0 dormir \u00e0 m\u00eame le sol ou \u00e0 se relayer pour s\u2019asseoir et s\u2019allonger.<\/p>\n<p data-start=\"3657\" data-end=\"4116\">Cette situation est aggrav\u00e9e par les fortes chaleurs estivales et par l\u2019insuffisance de la ventilation naturelle ou artificielle, ce qui a des r\u00e9percussions n\u00e9gatives sur la sant\u00e9 physique et mentale des personnes d\u00e9tenues. Dans certains centres, des solutions temporaires ont \u00e9t\u00e9 mises en place, telles que l\u2019installation de climatiseurs mobiles ou de ventilateurs, mais ces mesures restent partielles et ne traitent pas les causes structurelles du probl\u00e8me.<\/p>\n<h3 data-start=\"4118\" data-end=\"4197\">Des infrastructures vieillissantes et des besoins essentiels non satisfaits<\/h3>\n<p data-start=\"4199\" data-end=\"4691\">Outre la surpopulation, les visites ont r\u00e9v\u00e9l\u00e9 une d\u00e9gradation notable des infrastructures de plusieurs lieux de d\u00e9tention. Murs fissur\u00e9s, sols d\u00e9t\u00e9rior\u00e9s, humidit\u00e9, et absence d\u2019entretien r\u00e9gulier constituent un tableau r\u00e9current. Dans certains centres, l\u2019absence d\u2019eau chaude ou la faiblesse des r\u00e9seaux d\u2019assainissement ont \u00e9galement \u00e9t\u00e9 constat\u00e9es, affectant directement les conditions d\u2019hygi\u00e8ne et de sant\u00e9 publique, en particulier dans les r\u00e9gions froides ou durant la saison hivernale.<\/p>\n<p data-start=\"4693\" data-end=\"5087\">Bien que certaines am\u00e9liorations techniques aient \u00e9t\u00e9 introduites dans plusieurs postes, comme l\u2019installation de syst\u00e8mes d\u2019\u00e9nergie solaire pour assurer l\u2019\u00e9lectricit\u00e9, ces avanc\u00e9es, aussi importantes soient-elles, ne compensent pas le besoin d\u2019une r\u00e9habilitation globale des lieux de d\u00e9tention, ni l\u2019absence d\u2019une politique nationale claire de mise \u00e0 niveau des espaces de privation de libert\u00e9.<\/p>\n<h3 data-start=\"5089\" data-end=\"5144\">Les agents de s\u00e9curit\u00e9 entre pression et engagement<\/h3>\n<p data-start=\"5146\" data-end=\"5537\">L\u2019\u00e9valuation n\u2019a pas port\u00e9 uniquement sur la situation des personnes d\u00e9tenues, mais \u00e9galement sur celle des agents de s\u00e9curit\u00e9 travaillant dans ces centres. Les \u00e9changes ont mis en \u00e9vidence une p\u00e9nurie manifeste d\u2019effectifs au regard de la charge de travail qui leur incombe, en particulier dans les postes couvrant de vastes zones g\u00e9ographiques ou des r\u00e9gions \u00e0 forte densit\u00e9 de population.<\/p>\n<p data-start=\"5539\" data-end=\"6057\">Malgr\u00e9 cette pression, plusieurs chefs de poste et agents ont fait preuve d\u2019une coop\u00e9ration notable avec les \u00e9quipes de visite et d\u2019une compr\u00e9hension de l\u2019importance du r\u00f4le de la Commission nationale des droits de l\u2019homme. Beaucoup ont exprim\u00e9 leur conviction que l\u2019am\u00e9lioration des conditions de d\u00e9tention ne sert pas uniquement l\u2019int\u00e9r\u00eat des d\u00e9tenus, mais contribue \u00e9galement \u00e0 all\u00e9ger les contraintes quotidiennes pesant sur les agents et \u00e0 promouvoir un environnement de travail plus humain et plus professionnel.<\/p>\n<h3 data-start=\"6059\" data-end=\"6116\">La d\u00e9tention provisoire entre le droit et la pratique<\/h3>\n<p data-start=\"6118\" data-end=\"6547\">Sur le plan juridique, l\u2019examen des dossiers a r\u00e9v\u00e9l\u00e9 d\u2019importantes disparit\u00e9s entre les situations. Alors que certaines personnes \u00e9taient d\u00e9tenues depuis de courtes p\u00e9riodes et ne remplissaient pas encore les conditions de mise en libert\u00e9, d\u2019autres dossiers faisaient appara\u00eetre des cas de d\u00e9tention prolong\u00e9e, de personnes priv\u00e9es de repr\u00e9sentation juridique, ou encore de d\u00e9tenus ignorant totalement leur situation judiciaire.<\/p>\n<p data-start=\"6549\" data-end=\"7093\">Dans ce contexte, l\u2019intervention juridique a jou\u00e9 un r\u00f4le central, que ce soit par la pr\u00e9paration de demandes de mise en libert\u00e9, le d\u00e9p\u00f4t de recours contre d\u2019anciens jugements rendus par d\u00e9faut, ou m\u00eame l\u2019explication des droits et proc\u00e9dures les plus \u00e9l\u00e9mentaires aux personnes d\u00e9tenues. Des situations humanitaires particuli\u00e8res ont \u00e9galement \u00e9t\u00e9 relev\u00e9es, concernant des d\u00e9tenus vivant dans une extr\u00eame pr\u00e9carit\u00e9 ou dans des conditions sociales fragiles, mettant en lumi\u00e8re l\u2019interd\u00e9pendance profonde entre justice p\u00e9nale et justice sociale.<\/p>\n<h3 data-start=\"7095\" data-end=\"7160\">L\u2019impact de l\u2019intervention : de petits pas \u00e0 l\u2019effet tangible<\/h3>\n<p data-start=\"7162\" data-end=\"7593\">Malgr\u00e9 des moyens limit\u00e9s, les visites ont d\u00e9montr\u00e9 que l\u2019intervention juridique directe peut produire des effets concrets. La pr\u00e9paration d\u2019une demande de mise en libert\u00e9 ou la r\u00e9ouverture d\u2019un dossier n\u00e9glig\u00e9 ne modifie pas seulement le sort d\u2019un individu, mais contribue aussi \u00e0 r\u00e9duire la pression au sein des lieux de d\u00e9tention et \u00e0 r\u00e9affirmer que le droit demeure une voie possible, m\u00eame dans les contextes les plus fragiles.<\/p>\n<p data-start=\"7595\" data-end=\"7891\">Par ailleurs, la visite en elle-m\u00eame, l\u2019\u00e9coute des personnes d\u00e9tenues et l\u2019explication de leurs droits rev\u00eatent une dimension symbolique importante, r\u00e9habilitant l\u2019id\u00e9e d\u2019un contr\u00f4le ind\u00e9pendant et rappelant que les lieux de d\u00e9tention ne sont pas des espaces soustraits \u00e0 la reddition de comptes.<\/p>\n<h3 data-start=\"7893\" data-end=\"7935\">Des conclusions qui d\u00e9passent les murs<\/h3>\n<p data-start=\"7937\" data-end=\"8391\">Ces visites montrent que la crise des lieux de d\u00e9tention au Liban n\u2019est ni locale ni conjoncturelle, mais constitue l\u2019expression d\u2019un dysfonctionnement structurel appelant une approche globale. La surpopulation, la d\u00e9gradation des infrastructures, la lenteur des proc\u00e9dures judiciaires et le manque de ressources humaines sont des \u00e9l\u00e9ments \u00e9troitement li\u00e9s qui ne peuvent \u00eatre trait\u00e9s ind\u00e9pendamment d\u2019une r\u00e9forme plus large du syst\u00e8me de justice p\u00e9nale.<\/p>\n<p data-start=\"8393\" data-end=\"9077\" data-is-last-node=\"\" data-is-only-node=\"\">Dans cette perspective, la Commission nationale des droits de l\u2019homme, incluant le Comit\u00e9 pour la pr\u00e9vention de la torture, affirme que la poursuite des visites de terrain et le renforcement de la coop\u00e9ration avec les Forces de s\u00e9curit\u00e9 int\u00e9rieure et l\u2019autorit\u00e9 judiciaire constituent des leviers essentiels pour am\u00e9liorer les conditions de d\u00e9tention.
