data-start=\"309\" data-end=\"3271\"><strong data-start=\"309\" data-end=\"319\">Motifs<\/strong><br data-start=\"319\" data-end=\"322\" \/>Consid\u00e9rant que les syst\u00e8mes internationaux et r\u00e9gionaux des droits de l&rsquo;homme connaissent une croissance continue dans l\u2019adoption des trait\u00e9s internationaux relatifs aux droits de l\u2019homme ;<br data-start=\"512\" data-end=\"515\" \/>Et consid\u00e9rant que ces trait\u00e9s, une fois ratifi\u00e9s, imposent \u00e0 l\u2019\u00c9tat de nombreuses obligations essentielles qu\u2019il convient de respecter et de mettre en \u0153uvre, notamment la coop\u00e9ration et la communication avec les instances internationales cr\u00e9\u00e9es pour assurer l&rsquo;application de leurs dispositions et r\u00e8gles ;<br data-start=\"821\" data-end=\"824\" \/>Et consid\u00e9rant que les conventions ont d\u00e9fini les moyens de communication et d\u2019interaction positive avec les organes qui en d\u00e9coulent, notamment la pr\u00e9paration des rapports initiaux et p\u00e9riodiques et le suivi de la mise en \u0153uvre des recommandations qu\u2019ils \u00e9mettent ;<br data-start=\"1090\" data-end=\"1093\" \/>Et consid\u00e9rant que l\u2019\u00c9tat libanais a ratifi\u00e9 la majorit\u00e9 de ces trait\u00e9s et s\u2019est engag\u00e9 \u00e0 adopter les mesures n\u00e9cessaires pour respecter leurs dispositions et interagir avec les m\u00e9canismes des droits de l\u2019homme en d\u00e9coulant ;<br data-start=\"1318\" data-end=\"1321\" \/>Et consid\u00e9rant que les organes internationaux ont lanc\u00e9 de nombreux appels aux \u00c9tats, y compris le Liban, pour cr\u00e9er des m\u00e9canismes nationaux de pr\u00e9paration des rapports et de suivi, en particulier conform\u00e9ment \u00e0 la r\u00e9solution 68\/268 de l\u2019Assembl\u00e9e g\u00e9n\u00e9rale des Nations Unies visant \u00e0 renforcer l\u2019efficacit\u00e9 du syst\u00e8me des organes conventionnels des droits de l\u2019homme, ainsi qu\u2019aux recommandations du Conseil des droits de l\u2019homme lors de l\u2019Examen p\u00e9riodique universel du Liban en octobre 2015 ;<br data-start=\"1816\" data-end=\"1819\" \/>Et consid\u00e9rant les nombreuses probl\u00e9matiques rencontr\u00e9es dans la pr\u00e9paration par le Liban des rapports nationaux exig\u00e9s par les comit\u00e9s des trait\u00e9s et le Conseil des droits de l\u2019homme de l\u2019ONU, notamment en ce qui concerne la coordination entre les minist\u00e8res concern\u00e9s, la consultation de la soci\u00e9t\u00e9 civile et la difficult\u00e9 d\u2019obtenir des informations des parties concern\u00e9es, ce qui a clairement eu un impact n\u00e9gatif sur la qualit\u00e9 et la ponctualit\u00e9 des rapports, emp\u00eachant le Liban de respecter ses engagements et nuisant \u00e0 sa r\u00e9putation dans les forums internationaux ;<br data-start=\"2390\" data-end=\"2393\" \/>Et consid\u00e9rant que la cr\u00e9ation de ce m\u00e9canisme permettrait de r\u00e9soudre ces probl\u00e9matiques et de produire des r\u00e9sultats positifs, \u00e0 travers la mise en place d\u2019une structure nationale de coordination r\u00e9unissant r\u00e9guli\u00e8rement les diff\u00e9rents minist\u00e8res concern\u00e9s, afin de pr\u00e9senter une position libanaise unifi\u00e9e sur la sc\u00e8ne internationale et r\u00e9gionale, d\u2019\u00e9viter les divergences, de renforcer les capacit\u00e9s humaines et professionnelles dans le domaine des droits de l\u2019homme, d\u2019\u00e9laborer une politique nationale g\u00e9n\u00e9rale en mati\u00e8re de droits de l\u2019homme et de travailler \u00e0 son renforcement ;<br data-start=\"2978\" data-end=\"2981\" \/>Et consid\u00e9rant que plusieurs pays arabes fr\u00e8res ont devanc\u00e9 le Liban dans la cr\u00e9ation de ce m\u00e9canisme national et \u0153uvrent \u00e0 son d\u00e9veloppement, il ne convient pas que le Liban \u2013 pionnier des droits de l\u2019homme dans sa r\u00e9gion et membre fondateur de l\u2019ONU \u2013 ne prenne pas une telle initiative ;<\/p>\n<p data-start=\"3273\" data-end=\"3757\">Nous soumettons donc une proposition de projet de d\u00e9cret portant cr\u00e9ation d\u2019un m\u00e9canisme national en tant qu\u2019entit\u00e9 gouvernementale regroupant les divers minist\u00e8res et organismes administratifs concern\u00e9s, avec un mandat permanent. Il aura pour mission de couvrir tous les m\u00e9canismes des droits de l\u2019homme (l\u2019Examen p\u00e9riodique universel, les organes conventionnels, les proc\u00e9dures sp\u00e9ciales), avec la capacit\u00e9 de coordination, de pr\u00e9paration des rapports, de participation et de suivi.<\/p>\n<p data-start=\"3759\" data-end=\"3983\"><strong data-start=\"3759\" data-end=\"3792\">Le Pr\u00e9sident de la R\u00e9publique<\/strong>,<br data-start=\"3793\" data-end=\"3796\" \/>Vu la Constitution,<br data-start=\"3815\" data-end=\"3818\" \/>Sur proposition du Pr\u00e9sident du Conseil des ministres,<br data-start=\"3872\" data-end=\"3875\" \/>Apr\u00e8s approbation du Conseil des ministres en ses s\u00e9ances des 8\/2\/2018 et 21\/3\/2018,<br data-start=\"3959\" data-end=\"3962\" \/>D\u00e9cr\u00e8te ce qui suit :<\/p>\n<p data-start=\"3985\" data-end=\"4287\"><strong data-start=\"3985\" data-end=\"3998\">Article 1<\/strong><br data-start=\"3998\" data-end=\"4001\" \/>Il est cr\u00e9\u00e9 un Comit\u00e9 national pour la pr\u00e9paration des rapports relatifs aux trait\u00e9s internationaux sur les droits de l\u2019homme et le suivi des recommandations \u00e9mises par les m\u00e9canismes internationaux de protection des droits de l\u2019homme, pr\u00e9sid\u00e9 par le Pr\u00e9sident du Conseil des ministres.<\/p>\n<p data-start=\"4289\" data-end=\"4468\"><strong data-start=\"4289\" data-end=\"4302\">Article 2<\/strong><br data-start=\"4302\" data-end=\"4305\" \/>Le secr\u00e9tariat g\u00e9n\u00e9ral du Comit\u00e9 est assur\u00e9 par le Ministre des Affaires \u00e9trang\u00e8res et des \u00e9migr\u00e9s ou son d\u00e9l\u00e9gu\u00e9.<br data-start=\"4419\" data-end=\"4422\" \/>Le Comit\u00e9 est compos\u00e9 des membres suivants :<\/p>\n<ol data-start=\"4469\" data-end=\"5975\">\n<li data-start=\"4469\" data-end=\"4531\">\n<p data-start=\"4472\" data-end=\"4531\">Un repr\u00e9sentant de la Pr\u00e9sidence du Conseil des ministres<\/p>\n<\/li>\n<li data-start=\"4532\" data-end=\"4604\">\n<p data-start=\"4535\" data-end=\"4604\">Un repr\u00e9sentant du minist\u00e8re des Affaires \u00e9trang\u00e8res et des \u00e9migr\u00e9s<\/p>\n<\/li>\n<li data-start=\"4605\" data-end=\"4652\">\n<p data-start=\"4608\" data-end=\"4652\">Un repr\u00e9sentant du minist\u00e8re de la Justice<\/p>\n<\/li>\n<li data-start=\"4653\" data-end=\"4825\">\n<p data-start=\"4656\" data-end=\"4825\">Trois repr\u00e9sentants du minist\u00e8re des Affaires sociales : un du minist\u00e8re, un du Conseil sup\u00e9rieur de l\u2019enfance, et un du Comit\u00e9 national pour les personnes handicap\u00e9es<\/p>\n<\/li>\n<li data-start=\"4826\" data-end=\"4949\">\n<p data-start=\"4829\" data-end=\"4949\">Deux repr\u00e9sentants du minist\u00e8re de l\u2019Int\u00e9rieur et des Municipalit\u00e9s (Forces de s\u00e9curit\u00e9 int\u00e9rieure et S\u00fbret\u00e9 g\u00e9n\u00e9rale)<\/p>\n<\/li>\n<li data-end=\"5975\">\n<p data-start=\"5812\" data-end=\"5975\">Le ministre d\u2019\u00c9tat pour l\u2019autonomisation \u00e9conomique des femmes et des jeunes<br data-start=\"5888\" data-end=\"5891\" \/>Le Comit\u00e9 peut inviter tout organisme officiel concern\u00e9 \u00e0 participer \u00e0 ses r\u00e9unions.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"5977\" data-end=\"6043\"><strong data-start=\"5977\" data-end=\"5990\">Article 3<\/strong><br data-start=\"5990\" data-end=\"5993\" \/>Le Comit\u00e9 national assure les t\u00e2ches suivantes :<\/p>\n<ul data-start=\"6044\" data-end=\"6737\">\n<li data-start=\"6044\" data-end=\"6122\">\n<p data-start=\"6046\" data-end=\"6122\">Collecte d\u2019informations aupr\u00e8s des minist\u00e8res et organismes administratifs<\/p>\n<\/li>\n<li data-start=\"6123\" data-end=\"6156\">\n<p data-start=\"6125\" data-end=\"6156\">Gestion r\u00e9guli\u00e8re des donn\u00e9es<\/p>\n<\/li>\n<li data-start=\"6157\" data-end=\"6228\">\n<p data-start=\"6159\" data-end=\"6228\">R\u00e9daction et soumission des rapports internationaux dans les d\u00e9lais<\/p>\n<\/li>\n<li data-start=\"6229\" data-end=\"6341\">\n<p data-start=\"6231\" data-end=\"6341\">Suivi des recommandations internationales, pr\u00e9paration des r\u00e9ponses de l\u2019\u00c9tat et suivi de leur mise en \u0153uvre<\/p>\n<\/li>\n<li data-start=\"6342\" data-end=\"6449\">\n<p data-start=\"6344\" data-end=\"6449\">Coordination avec le pouvoir judiciaire pour les r\u00e9f\u00e9rences aux trait\u00e9s et la collecte des statistiques<\/p>\n<\/li>\n<li data-start=\"6450\" data-end=\"6524\">\n<p data-start=\"6452\" data-end=\"6524\">Coordination avec le Parlement et suivi des d\u00e9veloppements l\u00e9gislatifs<\/p>\n<\/li>\n<li data-start=\"6525\" data-end=\"6663\">\n<p data-start=\"6527\" data-end=\"6663\">Coordination avec l\u2019Institution nationale des droits de l\u2019homme et la Commission nationale permanente pour la pr\u00e9vention de la torture<\/p>\n<\/li>\n<li data-start=\"6664\" data-end=\"6737\">\n<p data-start=\"6666\" data-end=\"6737\">Consultation et coordination avec les ONG de d\u00e9fense des droits humains<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"6739\" data-end=\"7103\"><strong data-start=\"6739\" data-end=\"6752\">Article 4<\/strong><br data-start=\"6752\" data-end=\"6755\" \/>Le Comit\u00e9 dispose du pouvoir de repr\u00e9senter l\u2019\u00c9tat aupr\u00e8s des m\u00e9canismes internationaux et r\u00e9gionaux des droits de l\u2019homme, de r\u00e9pondre aux communications, aux rapports des rapporteurs sp\u00e9ciaux en visite au Liban, de coordonner et faciliter ces visites, et d\u2019interagir avec les instances gouvernementales et non gouvernementales pour les valoriser.<\/p>\n<p data-start=\"7105\" data-end=\"7351\"><strong data-start=\"7105\" data-end=\"7118\">Article 5<\/strong><br data-start=\"7118\" data-end=\"7121\" \/>Un secr\u00e9tariat est institu\u00e9 aupr\u00e8s du Comit\u00e9, charg\u00e9 des t\u00e2ches ex\u00e9cutives, notamment la gestion des informations, la cr\u00e9ation d\u2019une base de donn\u00e9es, l\u2019organisation des r\u00e9unions et la coordination entre les minist\u00e8res repr\u00e9sent\u00e9s.<\/p>\n<p data-start=\"7353\" data-end=\"7468\"><strong data-start=\"7353\" data-end=\"7366\">Article 6<\/strong><br data-start=\"7366\" data-end=\"7369\" \/>Les membres du Comit\u00e9 disposent de la libert\u00e9 d\u2019organisation pour garantir l\u2019efficacit\u00e9 du travail.<\/p>\n<p data-start=\"7470\" data-end=\"7743\"><strong data-start=\"7470\" data-end=\"7483\">Article 7<\/strong><br data-start=\"7483\" data-end=\"7486\" \/>Les indemnit\u00e9s du personnel du secr\u00e9tariat sont fix\u00e9es par d\u00e9cret sur proposition du ministre d\u2019\u00c9tat charg\u00e9 des droits de l\u2019homme.
