{"id":3206,"date":"2025-07-02T11:24:37","date_gmt":"2025-07-02T11:24:37","guid":{"rendered":"https:\/\/nhrclb.org\/archives\/3206"},"modified":"2025-07-02T11:32:25","modified_gmt":"2025-07-02T11:32:25","slug":"how-national-human-rights-institutions-can-act-on-international-violations","status":"publish","type":"post","link":"https:\/\/nhrclb.org\/fr\/archives\/3206","title":{"rendered":"Comment les Institutions Nationales des Droits de l&rsquo;Homme peuvent agir face aux violations internationales"},"content":{"rendered":"<p data-start=\"67\" data-end=\"353\"><strong data-start=\"67\" data-end=\"353\">Le Forum Asie-Pacifique des Institutions Nationales des Droits de l&rsquo;Homme (APF) a franchi une \u00e9tape importante pour soutenir les d\u00e9fenseurs des droits de l&rsquo;homme \u00e0 travers l&rsquo;Asie de l&rsquo;Ouest en rendant l&rsquo;un de ses principaux documents d&rsquo;orientation disponible en anglais et en arabe.<\/strong><\/p>\n<p data-start=\"355\" data-end=\"847\">Le document de politique intitul\u00e9 <em data-start=\"389\" data-end=\"538\">\u00ab Action nationale sur les questions internationales : le r\u00f4le des INDH en mati\u00e8re de cas et de situations de droits de l&rsquo;homme extraterritoriaux \u00bb<\/em> offre des orientations essentielles sur la mani\u00e8re dont les Institutions Nationales des Droits de l&rsquo;Homme (INDH) peuvent r\u00e9pondre aux violations des droits de l&rsquo;homme qui se produisent au-del\u00e0 de leurs fronti\u00e8res nationales \u2014 une question de plus en plus pertinente dans un monde toujours plus interconnect\u00e9.<\/p>\n<p data-start=\"849\" data-end=\"1390\">Initialement r\u00e9dig\u00e9 en anglais par le c\u00e9l\u00e8bre expert des droits de l&rsquo;homme, le professeur Chris Sidoti, avec les contributions des INDH de toute la r\u00e9gion Asie-Pacifique, ce document explore comment ces institutions peuvent mobiliser leurs mandats juridiques existants pour traiter les violations des droits de l&rsquo;homme se produisant en dehors de leurs territoires. Avec la publication de la version arabe, ces connaissances essentielles sont d\u00e9sormais accessibles aux INDH et aux d\u00e9fenseurs des droits de l&rsquo;homme \u00e0 travers l&rsquo;Asie de l&rsquo;Ouest.<\/p>\n<h3 data-start=\"1392\" data-end=\"1463\">Briser le mythe : Les INDH ne sont pas confin\u00e9es par les fronti\u00e8res<\/h3>\n<p data-start=\"1465\" data-end=\"2162\">Comment une institution nationale peut-elle traiter des violations des droits de l&rsquo;homme dans un autre pays ? C&rsquo;est la question centrale abord\u00e9e par ce document, qui offre \u00e0 la fois une clart\u00e9 conceptuelle et des exemples pratiques. Le document souligne que de nombreuses INDH, op\u00e9rant strictement dans le cadre de leurs lois nationales, ont d\u00e9j\u00e0 pris des mesures courageuses sur des questions internationales \u2014 de la d\u00e9nonciation de l&rsquo;occupation isra\u00e9lienne de la Palestine \u00e0 l&rsquo;enqu\u00eate sur l&rsquo;impact de la dictature militaire en Birmanie, en passant par la gestion des cons\u00e9quences du changement climatique, des op\u00e9rations mini\u00e8res abusives et du traitement des travailleurs migrants \u00e0 l&rsquo;\u00e9tranger.<\/p>\n<p data-start=\"2164\" data-end=\"2364\">Ces exemples, loin d&rsquo;\u00eatre de simples exercices th\u00e9oriques, d\u00e9montrent que les INDH ont un v\u00e9ritable potentiel pour influencer les r\u00e9sultats en mati\u00e8re de droits de l&rsquo;homme au-del\u00e0 de leurs fronti\u00e8res.<\/p>\n<h3 data-start=\"2366\" data-end=\"2407\">Cinq voies d&rsquo;engagement international<\/h3>\n<p data-start=\"2409\" data-end=\"2561\">Le document identifie cinq fonctions essentielles par lesquelles les INDH peuvent s&rsquo;engager dans les questions de droits de l&rsquo;homme extraterritoriales :<\/p>\n<ul data-start=\"2563\" data-end=\"2883\">\n<li data-start=\"2563\" data-end=\"2624\">\n<p data-start=\"2565\" data-end=\"2624\">Enqu\u00eater et r\u00e9soudre les violations des droits de l&rsquo;homme<\/p>\n<\/li>\n<li data-start=\"2625\" data-end=\"2683\">\n<p data-start=\"2627\" data-end=\"2683\">Mener des enqu\u00eates nationales sur les abus syst\u00e9miques<\/p>\n<\/li>\n<li data-start=\"2684\" data-end=\"2745\">\n<p data-start=\"2686\" data-end=\"2745\">Fournir des conseils et des recommandations aux autorit\u00e9s<\/p>\n<\/li>\n<li data-start=\"2746\" data-end=\"2802\">\n<p data-start=\"2748\" data-end=\"2802\">Participer aux efforts de coop\u00e9ration internationale<\/p>\n<\/li>\n<li data-start=\"2803\" data-end=\"2883\">\n<p data-start=\"2805\" data-end=\"2883\">Promouvoir l&rsquo;\u00e9ducation aux droits de l&rsquo;homme et la sensibilisation du public<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2885\" data-end=\"3091\">Ce faisant, les INDH r\u00e9pondent non seulement aux pr\u00e9occupations urgentes en mati\u00e8re de droits de l&rsquo;homme, mais renforcent \u00e9galement leur cr\u00e9dibilit\u00e9 et leur pertinence aux niveaux national et international.<\/p>\n<h3 data-start=\"3093\" data-end=\"3143\">Une ressource opportune pour l&rsquo;Asie de l&rsquo;Ouest<\/h3>\n<p data-start=\"3145\" data-end=\"3700\">La disponibilit\u00e9 de cette ressource en arabe arrive \u00e0 un moment crucial pour la r\u00e9gion. \u00c0 travers l&rsquo;Asie de l&rsquo;Ouest, l&rsquo;int\u00e9r\u00eat \u2014 et le besoin \u2014 pour que les INDH explorent comment elles peuvent contribuer \u00e0 la gestion des violations transnationales des droits de l&rsquo;homme ne cessent de cro\u00eetre. Des conflits et d\u00e9placements forc\u00e9s \u00e0 l&rsquo;exploitation des travailleurs migrants, les d\u00e9fis auxquels la r\u00e9gion est confront\u00e9e d\u00e9passent les fronti\u00e8res et n\u00e9cessitent des r\u00e9ponses \u00e0 la fois juridiquement solides et ancr\u00e9es dans les principes des droits de l&rsquo;homme.<\/p>\n<p data-start=\"3702\" data-end=\"4107\">La traduction en arabe de ce document de politique fait partie de l&rsquo;engagement plus large de l&rsquo;APF \u00e0 fournir des ressources adapt\u00e9es et \u00e0 favoriser la coop\u00e9ration r\u00e9gionale entre ses membres.
