{"id":5225,"date":"2024-05-02T14:24:25","date_gmt":"2024-05-02T11:24:25","guid":{"rendered":"https:\/\/nhrclb.org\/archives\/5225"},"modified":"2026-03-19T11:14:33","modified_gmt":"2026-03-19T09:14:33","slug":"%d8%a8%d9%8a%d8%a7%d9%86-%d9%85%d8%b4%d8%aa%d8%b1%d9%83-%d9%84%d9%80-8-%d9%85%d9%86%d8%b8%d9%85%d8%a7%d8%aa-%d8%ba%d9%8a%d8%b1-%d8%ad%d9%83%d9%88%d9%85%d9%8a%d8%a9-%d8%a7%d8%ad%d8%aa%d8%b1%d9%85","status":"publish","type":"post","link":"https:\/\/nhrclb.org\/en\/archives\/5225","title":{"rendered":"Joint Statement \u2013 Respect International Law in EU-Lebanon Migration Deal"},"content":{"rendered":"<p dir=\"RTL\">Lebanese authorities and the European Union must respect their obligations<br \/>\nunder international law and not forcibly return refugees to Syria as long as the<br \/>\nconditions for safe, voluntary and dignified returns are not met, eight Non-governmental organizations<br \/>\n(The Coalition of the North-South movement in Flanders 11.11.11, Access Center for Human Rights (ACHR), Amnesty International, Centre Libanais des Droits Humains (CLDH), EuroMed Rights, Human Rights Watch, PAX, and Syrian Network for Human Rights, said today ahead of European<br \/>\nCommission President Ursula von Der Leyen\u2019s visit to Beirut.<br \/>\nIn recent months, the Lebanese government has advocated for an EU-Lebanon<br \/>\nmigration deal under which the EU, according to media reports, would provide<br \/>\nadditional financial support to Lebanese security agencies to prevent people,<br \/>\nincluding Syrian refugees, Lebanese individuals and other nationals living in<br \/>\nLebanon, from trying to reach European states. The deal would also expand<br \/>\nreturn assistance programming to so-called \u201csafe areas\u201d inside Syria to<br \/>\nincentivize refugee returns.<br \/>\nThis is the latest in a series of migration cooperation deals negotiated by the EU<br \/>\nthat seeks to enlist third countries\u2019 assistance on border control and that are<br \/>\npremised on the abdication of responsibility for people seeking safety. These<br \/>\ndeals expose individuals to human rights risks, erode asylum protection and<br \/>\nundermine the international protection system as a whole. These agreements<br \/>\nevade public, parliamentary, and judicial oversight in the EU and partner<br \/>\ncountries and consistently lack adequate monitoring and oversight mechanisms<br \/>\nto ensure the EU is not complicit in human rights violations.<br \/>\nNo parts of Syria are safe for returns. The United Nations continues to\u00a0<a href=\"https:\/\/reliefweb.int\/report\/syrian-arab-republic\/syrian-arab-republic-2024-humanitarian-needs-overview-february-2024#%3A%7E%3Atext%3DIn%202024%2C%2016.7%20million%20people%2Cof%20the%20crisis%20in%202011.%26text%3DSyria%20remains%20a%20protection%20crisis\" target=\"_blank\" rel=\"noopener\">maintain<\/a><br \/>\nthat conditions in Syria are \u201cnot conducive to safe and dignified return\u201d. In April<br \/>\n2024, the European Union Agency for Asylum (EUAA)\u00a0<a href=\"https:\/\/euaa.europa.eu\/publications\/country-guidance-syria-april-2024\" target=\"_blank\" rel=\"noopener\">found<\/a>\u00a0that high or<br \/>\nsubstantive levels of indiscriminate violence continue to persist in most areas of<br \/>\nSyria and that the risk of being persecuted remains widespread. In recent<br \/>\nmonths, Syria has also experienced the worst\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/location\/middle-east-and-north-africa\/middle-east\/syria\/report-syria\/\" target=\"_blank\" rel=\"noopener\">escalation<\/a>\u00a0in violence since 2020.<br \/>\nIn the past two months alone, both the\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/03\/un-commission-inquiry-syria-too-desperately-needs-ceasefire\" target=\"_blank\" rel=\"noopener\">UN Commission of Inquiry for Syria<\/a>\u00a0and<br \/>\nthe Office of the UN High Commissioner for Human Rights (OHCHR) have issued<br \/>\nreports that\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/02\/syrian-returnees-subjected-gross-human-rights-violations-and-abuses-un\" target=\"_blank\" rel=\"noopener\">reiterated<\/a>\u00a0that Syria remains unsafe for return and that returnees are<br \/>\nspecifically being targeted upon return. Human rights organisations, including<br \/>\n<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2023\/04\/lebanon-authorities-must-halt-unlawful-deportations-of-syrian-refugees\/\" target=\"_blank\" rel=\"noopener\">Amnesty International<\/a>, Human Rights Watch and the Syrian Network for Human<br \/>\nRights, continue to document how Syrian security forces and government\u0002affiliated militias arbitrarily detain, torture, disappear and kill refugees who<br \/>\nreturn. These violations are often a\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/documents\/mde24\/4583\/2021\/en\/\" target=\"_blank\" rel=\"noopener\">direct consequence<\/a>\u00a0of perceived affiliation<br \/>\nwith the opposition simply based on individuals\u2019 decisions to leave the country<br \/>\nand seek refuge elsewhere.<br \/>\nGiven these conditions, EU assistance geared to enabling or incentivizing returns<br \/>\nto Syria risks resulting in forced returns of refugees, making Lebanon and the EU<br \/>\ncomplicit in violations of the customary international law principle of non\u0002refoulement, which obliges states not to forcibly return people to countries where<br \/>\nthey risk persecution or other serious human rights violations.<br \/>\nFurther, since 2019, Lebanese authorities have been\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2023\/05\/lebanon-halt-summary-deportations-of-syrian-refugees\/\" target=\"_blank\" rel=\"noopener\">summarily deporting<\/a>\u00a0Syrian<br \/>\nrefugees back to Syria, including through forced returns at the border, in violation<br \/>\nof the principle of non-refoulement.<br \/>\nAs such, EU support to Lebanese security agencies with the aim of curbing<br \/>\nmigration movements to Europe could result in Syrians resorting to even longer<br \/>\nand more dangerous routes to try to reach Europe\u2019s shores in order to avoid<br \/>\nforced deportation to Syria, making them reliant on smuggling networks and<br \/>\nvulnerable to trafficking.<br \/>\nLebanon remains the country hosting the largest number of refugees per capita,<br \/>\nwith the government estimating that 1.5 million Syrian refugees currently live in<br \/>\nthe country. The country has struggled to assist refugees amid an acute economic<br \/>\ncrisis that has pushed<a href=\"https:\/\/news.un.org\/en\/story\/2021\/09\/1099102\" target=\"_blank\" rel=\"noopener\">\u00a0over 80 percent<\/a>\u00a0of the population into poverty. Donor<br \/>\ncountries, including the EU, have dramatically reduced their funding for refugee<br \/>\nprogramming. Further, in 2023, only 2,800 Syrians were resettled to the EU<br \/>\nfrom Lebanon, which amounts to a mere 1% of the overall number of Syrians<br \/>\nliving in the country who were in need of resettlement. Recent decisions by the<br \/>\nUnited States and many EU member states to suspend funding to the United<br \/>\nNations Relief and Works Agency for Palestine Refugees in the Near East<br \/>\n(UNRWA) which provides assistance to 250,000 Palestinians in Lebanon \u2013 80<br \/>\nper cent already living under the poverty line, have put even more strain on<br \/>\nLebanon\u2019s refugee population, while the future of the organization remains in<br \/>\nquestion.<br \/>\nStronger EU support to Lebanon in meeting the needs of refugees is long<br \/>\noverdue. Well-managed cooperation with partner countries \u2013 based on human<br \/>\nrights and the rule of law \u2013 could deliver inclusive growth, sustainable<br \/>\ndevelopment, and advance strategic partnerships. Such partnerships must<br \/>\ninclude human rights risks and impact assessments, independent monitoring,<br \/>\nand clauses to suspend cooperation if abuses follow. Any EU-Lebanon migration<br \/>\npartnership should be aimed at protecting Syrian refugees in Lebanon, including<br \/>\nby halting summary deportations. Further, the EU should commit to providing<br \/>\nadditional funding to support refugee and Lebanese host communities, resettling<br \/>\na greater number of Syrian refugees residing in Lebanon to Europe, and ending<br \/>\nillegal pushbacks from EU countries to Lebanon.
