The decree comes as part of the process of reconstituting the Council after the expiry of the previous council\u2019s mandate, which had continued operating in a caretaker capacity since 2020.<\/p>\n<p data-start=\"610\" data-end=\"975\">The decree implements the amendments introduced by <strong data-start=\"661\" data-end=\"693\">Law No. 288 of 12 April 2022<\/strong>, which modified the founding <strong data-start=\"723\" data-end=\"746\">Law No. 389 of 1995<\/strong> governing the Council. The amendments broadened the Council\u2019s scope by introducing new sectors, notably <strong data-start=\"851\" data-end=\"911\">the environmental sector and civil society organizations<\/strong>, reflecting evolving approaches to public policy participation.<\/p>\n<p data-start=\"977\" data-end=\"1343\">Under <strong data-start=\"983\" data-end=\"1023\">Article 2, paragraph 9 of the decree<\/strong>, several organizations were designated as among the most representative bodies of the civil society sector. These include <strong data-start=\"1146\" data-end=\"1166\">The Legal Agenda<\/strong>, the <strong data-start=\"1172\" data-end=\"1210\">Lebanese Center for Policy Studies<\/strong>, <strong data-start=\"1212\" data-end=\"1233\">Policy Initiative<\/strong>, the <strong data-start=\"1239\" data-end=\"1285\">Lebanese Association for Taxpayers\u2019 Rights<\/strong>, and the <strong data-start=\"1295\" data-end=\"1342\">Arab Network for Economic and Social Rights<\/strong>.<\/p>\n<p data-start=\"1345\" data-end=\"1630\">Pursuant to <strong data-start=\"1357\" data-end=\"1389\">Article 8 of the amended law<\/strong>, these organizations must submit lists of nominees comprising at least <strong data-start=\"1461\" data-end=\"1514\">three times the number of seats allocated to them<\/strong>, from which the <strong data-start=\"1531\" data-end=\"1555\">Council of Ministers<\/strong> will appoint the final members representing the sector within the Council.<\/p>\n<p data-start=\"1632\" data-end=\"2260\">The Economic, Social and Environmental Council is an <strong data-start=\"1685\" data-end=\"1737\">independent consultative and representative body<\/strong> tasked with providing opinions on the country\u2019s economic, social, and environmental policies. The 2022 amendments expanded its mandate to include reviewing draft laws, national plans, and government programmes related to sectors represented in the Council. The Council may also organize <strong data-start=\"2025\" data-end=\"2049\">public consultations<\/strong> and receive <strong data-start=\"2062\" data-end=\"2122\">citizens\u2019 petitions signed by at least 5,000 individuals<\/strong>. However, its opinions remain <strong data-start=\"2153\" data-end=\"2165\">advisory<\/strong>, as the government is required to consult the Council but is not bound by its recommendations.<\/p>\n<p data-start=\"2262\" data-end=\"2601\">The Council is composed of <strong data-start=\"2289\" data-end=\"2303\">80 members<\/strong> representing nine sectors, including employers, trade unions, liberal professions, cooperatives and social institutions, environmental organizations, civil society, Lebanese expatriates, and experts in economic, social, legal, and cultural fields. Members serve <strong data-start=\"2566\" data-end=\"2600\">four-year terms renewable once<\/strong>.<\/p>\n<p data-start=\"2603\" data-end=\"2912\">The creation of the Council traces back to the <strong data-start=\"2650\" data-end=\"2673\">1989 Taif Agreement<\/strong>, which called for establishing a body that would enable various economic and social sectors to participate in shaping national policies. The Lebanese model was inspired in part by the <strong data-start=\"2858\" data-end=\"2911\">French Economic, Social and Environmental Council<\/strong>.<\/p>\n<p data-start=\"2914\" data-end=\"3415\">Nevertheless, the expansion of the Council\u2019s powers has raised <strong data-start=\"2977\" data-end=\"3005\">constitutional questions<\/strong>, particularly concerning the possibility for Parliament to refer draft legislation to the Council for opinion. Unlike the French system, where the Council is expressly established in the Constitution, the Lebanese Council exists only by statute, leading some observers to question whether certain consultative mechanisms are fully consistent with the constitutional framework governing legislative procedures.<\/p>\n<p data-start=\"3417\" data-end=\"3705\">The Council\u2019s recent performance has also been the subject of debate. Since the beginning of Lebanon\u2019s financial crisis in 2019, the Council has largely functioned as a forum for dialogue and consultation, with limited visible influence on policymaking despite its expanded legal mandate.<\/p>\n<p data-start=\"3707\" data-end=\"4089\">With the issuance of Decree No. 1713, the process of appointing a new Council is expected to move forward.
