The discussion takes place in the context of efforts to <strong data-start=\"743\" data-end=\"787\">reform Lebanon\u2019s criminal justice system<\/strong> by adopting <strong data-start=\"800\" data-end=\"840\">alternative measures to imprisonment<\/strong> that contribute to <strong data-start=\"860\" data-end=\"905\">reducing overcrowding in Lebanese prisons<\/strong> and improving the conditions of detainees, while allowing the judiciary to exercise <strong data-start=\"990\" data-end=\"1013\">effective oversight<\/strong> through modern electronic means that <strong data-start=\"1051\" data-end=\"1077\">preserve human dignity<\/strong> and <strong data-start=\"1082\" data-end=\"1127\">respect legal and human rights safeguards<\/strong>.<\/p>\n<h3 data-start=\"1132\" data-end=\"1172\"><strong data-start=\"1136\" data-end=\"1172\">Opinion Based on Law No. 62\/2016<\/strong><\/h3>\n<p data-start=\"1174\" data-end=\"1523\">Pursuant to <strong data-start=\"1186\" data-end=\"1219\">Article 15 of Law No. 62\/2016<\/strong>, which established the Commission and empowers it to issue opinions on draft laws and legislative proposals related to human rights, the Commission prepared a detailed opinion on the proposal based on a methodology that respects <strong data-start=\"1449\" data-end=\"1506\">international standards and United Nations principles<\/strong>, particularly:<\/p>\n<ul data-start=\"1525\" data-end=\"2175\">\n<li data-start=\"1525\" data-end=\"1696\">\n<p data-start=\"1527\" data-end=\"1696\">The <strong data-start=\"1531\" data-end=\"1562\">Nelson Mandela Rules (2015)<\/strong>, which affirm that pre-trial detention should be exceptional and that states should adopt non-custodial measures whenever possible.<\/p>\n<\/li>\n<li data-start=\"1697\" data-end=\"1893\">\n<p data-start=\"1699\" data-end=\"1893\">The <strong data-start=\"1703\" data-end=\"1731\">M\u00e9ndez Principles (2023)<\/strong> on the use of law enforcement equipment, which stipulate that all measures restricting liberty must be subject to judicial oversight and respect human dignity.<\/p>\n<\/li>\n<li data-start=\"1894\" data-end=\"2058\">\n<p data-start=\"1896\" data-end=\"2058\">The <strong data-start=\"1900\" data-end=\"1945\">Istanbul Protocol (2022, revised edition)<\/strong>, which links the prevention of torture with criminal justice reform and the safeguarding of detainees\u2019 rights.<\/p>\n<\/li>\n<li data-start=\"2059\" data-end=\"2175\">\n<p data-start=\"2061\" data-end=\"2175\">The <strong data-start=\"2065\" data-end=\"2089\">Bangkok Rules (2010)<\/strong> on the treatment of women prisoners and non-custodial measures for women offenders.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2177\" data-end=\"2265\"><strong data-start=\"2181\" data-end=\"2265\">Commission\u2019s View: A Reform Measure Provided Human Rights Guarantees Are Ensured<\/strong><\/h3>\n<p data-start=\"2267\" data-end=\"2543\">The Commission considers the adoption of electronic tagging a <strong data-start=\"2329\" data-end=\"2394\">qualitative step forward in Lebanon\u2019s criminal justice system<\/strong>, provided it is implemented within a <strong data-start=\"2432\" data-end=\"2465\">comprehensive legal framework<\/strong> that ensures judicial supervision and the protection of fundamental rights.<\/p>\n<p data-start=\"2545\" data-end=\"2836\">It emphasized that the decision to impose electronic tagging must be <strong data-start=\"2614\" data-end=\"2672\">judicially reasoned, time-bound, and subject to appeal<\/strong>, thereby strengthening the principle of a <strong data-start=\"2715\" data-end=\"2729\">fair trial<\/strong> enshrined in the Lebanese Constitution and the <strong data-start=\"2777\" data-end=\"2833\">International Covenant on Civil and Political Rights<\/strong>.<\/p>\n<p data-start=\"2838\" data-end=\"3214\">The Commission also stressed the importance of <strong data-start=\"2885\" data-end=\"2920\">protecting the right to privacy<\/strong>, by regulating the collection, monitoring, storage, and use of personal data in accordance with <strong data-start=\"3017\" data-end=\"3092\">Law No. 81\/2018 on electronic transactions and personal data protection<\/strong>, ensuring that electronic tagging does not become a tool for <strong data-start=\"3154\" data-end=\"3211\">arbitrary surveillance or intrusion into private life<\/strong>.<\/p>\n<p data-start=\"3216\" data-end=\"3573\">The Commission further noted that the success of this measure requires <strong data-start=\"3287\" data-end=\"3312\">independent oversight<\/strong>, such as that of the National Human Rights Commission, to ensure compliance with human rights standards during implementation. It also called for <strong data-start=\"3459\" data-end=\"3492\">psychosocial support programs<\/strong> for beneficiaries to facilitate their reintegration and prevent social stigma.<\/p>\n<h3 data-start=\"3575\" data-end=\"3608\"><strong data-start=\"3579\" data-end=\"3608\">Practical Recommendations<\/strong><\/h3>\n<p data-start=\"3610\" data-end=\"3662\">The Commission made the following recommendations:<\/p>\n<ol data-start=\"3663\" data-end=\"4413\">\n<li data-start=\"3663\" data-end=\"3874\">\n<p data-start=\"3666\" data-end=\"3874\"><strong data-start=\"3666\" data-end=\"3704\">Expressing its preliminary support<\/strong> for the adoption of electronic tagging as an alternative to pre-trial detention, as it represents a reform measure consistent with Lebanon\u2019s international commitments.<\/p>\n<\/li>\n<li data-start=\"3875\" data-end=\"4055\">\n<p data-start=\"3878\" data-end=\"4055\"><strong data-start=\"3878\" data-end=\"3916\">Calling on the Ministry of Justice<\/strong> to conduct a comprehensive study defining the required technical and legal infrastructure to ensure effective and secure implementation.<\/p>\n<\/li>\n<li data-start=\"4056\" data-end=\"4231\">\n<p data-start=\"4059\" data-end=\"4231\"><strong data-start=\"4059\" data-end=\"4137\">Issuing an implementing decree simultaneously with the adoption of the law<\/strong>, specifying mechanisms for judicial oversight and guarantees for privacy and human dignity.<\/p>\n<\/li>\n<li data-start=\"4232\" data-end=\"4413\">\n<p data-start=\"4235\" data-end=\"4413\"><strong data-start=\"4235\" data-end=\"4266\">Ensuring non-discrimination<\/strong> in the application of this measure, with clear criteria for the offenses eligible under this system, while excluding serious and violent crimes.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"4415\" data-end=\"4968\">The <strong data-start=\"4419\" data-end=\"4510\">National Human Rights Commission, including the Committee for the Prevention of Torture<\/strong>, affirms that the <strong data-start=\"4529\" data-end=\"4559\">electronic tagging project<\/strong>, if adopted within a <strong data-start=\"4581\" data-end=\"4613\">human-rights-based framework<\/strong>, would constitute a <strong data-start=\"4634\" data-end=\"4714\">qualitative transformation toward a more humane and effective justice system<\/strong> in Lebanon.
