{"id":3551,"date":"2025-10-07T09:31:50","date_gmt":"2025-10-07T09:31:50","guid":{"rendered":"https:\/\/nhrclb.org\/?p=3551"},"modified":"2025-10-24T09:44:21","modified_gmt":"2025-10-24T09:44:21","slug":"lebanons-national-human-rights-commission-engages-with-un-expert-on-the-right-to-life","status":"publish","type":"post","link":"https:\/\/nhrclb.org\/en\/archives\/3551","title":{"rendered":"Lebanon\u2019s National Human Rights Commission Engages with UN Expert on the Right to Life"},"content":{"rendered":"<p data-start=\"379\" data-end=\"714\">At the invitation of the Government of Lebanon, the UN Special Rapporteur on extrajudicial, summary or arbitrary executions, <a href=\"https:\/\/www.ohchr.org\/en\/special-procedures\/sr-executions\/mr-morris-tidball-binz\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"504\" data-end=\"531\">Dr. Morris Tidball-Binz<\/strong>,<\/a> conducted an <a href=\"https:\/\/www.ohchr.org\/en\/media-advisories\/2025\/09\/un-expert-unlawful-killings-visit-lebanon\" target=\"_blank\" rel=\"noopener\">official country visit<\/a> from <strong data-start=\"578\" data-end=\"613\">29 September to 10 October 2025<\/strong> to assess protection of the <strong data-start=\"642\" data-end=\"659\">right to life<\/strong> under international human rights and humanitarian law.<\/p>\n<p data-start=\"716\" data-end=\"1283\">As part of this mission, <strong data-start=\"741\" data-end=\"763\">on 07 October 2025<\/strong> Dr. Tidball-Binz visited the <strong data-start=\"793\" data-end=\"824\">NHRC-CPT premises in Beirut<\/strong> <a href=\"https:\/\/nhrclb.org\/wp-content\/uploads\/2025\/10\/NHRCCPT-35_25.pdf\" target=\"_blank\" rel=\"noopener\">for an in-depth technical briefing and exchange with the Commission<\/a>, including <strong data-start=\"911\" data-end=\"942\">Mr. Fadi Gerges (President)<\/strong>, <strong data-start=\"944\" data-end=\"975\">Mr. Ali Youssef (Treasurer)<\/strong>, and <strong data-start=\"981\" data-end=\"1048\">Mr. Bassam Al Kantar (Commissioner for International Relations)<\/strong>. The meeting focused on institutional obstacles to effective death-investigation, case files on unlawful killings and custodial deaths, and pathways to strengthen medico-legal capacities in line with the <strong data-start=\"1253\" data-end=\"1282\">Minnesota Protocol (2016)<\/strong>.<\/p>\n<blockquote data-start=\"1285\" data-end=\"1518\">\n<p data-start=\"1287\" data-end=\"1518\"><strong data-start=\"1287\" data-end=\"1310\">NHRC-CPT statement:<\/strong> \u201cEvery life matters \u2014 and protecting it is both a legal duty and a moral responsibility. We stand ready to cooperate with the Special Rapporteur and all authorities to ensure truth, justice, and prevention.\u201d<\/p>\n<\/blockquote>\n<p data-start=\"1520\" data-end=\"1863\">The NHRC-CPT also expressed its appreciation to the <strong data-start=\"1572\" data-end=\"1635\">Office of the UN High Commissioner for Human Rights (OHCHR)<\/strong>\u2014in particular <strong data-start=\"1650\" data-end=\"1672\">Ms. Yasmine Ashraf<\/strong>, Human Rights Officer, Protection, Religion, Accountability and Human Security Section, Special Procedures Branch\u2014for her professionalism and coordination throughout the preparation process.<\/p>\n<h2 data-start=\"1870\" data-end=\"1931\">\u00a0Briefing Note submitted to the SR (2021\u20132025)<\/h2>\n<p data-start=\"1933\" data-end=\"2171\">Drawing on <strong data-start=\"1944\" data-end=\"1958\">five years<\/strong> of monitoring, detention visits, forensic documentation, and field evidence, the NHRC-CPT provided an independent, evidence-based account of the right-to-life situation in Lebanon (2021\u20132025). The note aims to:<\/p>\n<ul data-start=\"2172\" data-end=\"2486\">\n<li data-start=\"2172\" data-end=\"2266\">\n<p data-start=\"2174\" data-end=\"2266\">Inform findings on <strong data-start=\"2193\" data-end=\"2243\">extrajudicial, summary or arbitrary executions<\/strong> and state responses;<\/p>\n<\/li>\n<li data-start=\"2267\" data-end=\"2380\">\n<p data-start=\"2269\" data-end=\"2380\">Highlight <strong data-start=\"2279\" data-end=\"2321\">legislative\/institutional shortcomings<\/strong> hampering prevention, investigation, and accountability;<\/p>\n<\/li>\n<li data-start=\"2381\" data-end=\"2486\">\n<p data-start=\"2383\" data-end=\"2486\">Recommend measures to align Lebanon with the <strong data-start=\"2428\" data-end=\"2437\">ICCPR<\/strong>, <strong data-start=\"2439\" data-end=\"2446\">CAT<\/strong>, and the <strong data-start=\"2456\" data-end=\"2485\">Minnesota Protocol (2016)<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2488\" data-end=\"2513\">Institutional context<\/h3>\n<p data-start=\"2514\" data-end=\"2929\">Established by <strong data-start=\"2529\" data-end=\"2548\">Law No. 62\/2016<\/strong> as Lebanon\u2019s <strong data-start=\"2562\" data-end=\"2570\">NHRI<\/strong> and <strong data-start=\"2575\" data-end=\"2582\">NPM<\/strong>, the Commission remains <strong data-start=\"2607\" data-end=\"2636\">partially non-operational<\/strong> due to the Government\u2019s failure to adopt five essential decrees (internal\/financial regulations, code of ethics, members\u2019 compensation, contracting procedures). Despite this, the NHRC-CPT has maintained investigations and advisory work through donor support and members\u2019 voluntary commitment.<\/p>\n<h3 data-start=\"2931\" data-end=\"2959\">Key findings (2021\u20132025)<\/h3>\n<ul data-start=\"2960\" data-end=\"4053\">\n<li data-start=\"2960\" data-end=\"3194\">\n<p data-start=\"2962\" data-end=\"3194\"><strong data-start=\"2962\" data-end=\"3009\">Conflict-related killings &amp; IHL violations:<\/strong> Extensive attacks with high civilian tolls, including incidents affecting journalists, medical workers, and UN facilities, and alleged use of <strong data-start=\"3152\" data-end=\"3172\">white phosphorus<\/strong> in populated areas.<\/p>\n<\/li>\n<li data-start=\"3195\" data-end=\"3539\">\n<p data-start=\"3197\" data-end=\"3539\"><strong data-start=\"3197\" data-end=\"3229\">Deaths in custody &amp; torture:<\/strong> 200+ detention visits revealed <strong data-start=\"3261\" data-end=\"3277\">overcrowding<\/strong>, medical neglect, and corruption; multiple preventable deaths and unresolved torture cases persist. NHRC-CPT opened an <strong data-start=\"3397\" data-end=\"3426\">independent investigation<\/strong> into the reported suicide of a <strong data-start=\"3458\" data-end=\"3480\">14-year-old (M.A.)<\/strong> at Warwar Juvenile Rehabilitation Center (29 Sept 2025).<\/p>\n<\/li>\n<li data-start=\"3540\" data-end=\"3712\">\n<p data-start=\"3542\" data-end=\"3712\"><strong data-start=\"3542\" data-end=\"3569\">Excessive use of force:<\/strong> Lethal force by security agencies during protests and operations, with <strong data-start=\"3641\" data-end=\"3660\">non-independent<\/strong> inquiries that contravene the Minnesota Protocol.<\/p>\n<\/li>\n<li data-start=\"3713\" data-end=\"3870\">\n<p data-start=\"3715\" data-end=\"3870\"><strong data-start=\"3715\" data-end=\"3749\">Political killings &amp; impunity:<\/strong> Targeted killings of activists and officials remain unresolved; the Beirut Port Explosion victims still await justice.<\/p>\n<\/li>\n<li data-start=\"3871\" data-end=\"4053\">\n<p data-start=\"3873\" data-end=\"4053\"><strong data-start=\"3873\" data-end=\"3895\">Systemic barriers:<\/strong> Judicial inertia, political interference, gaps in <strong data-start=\"3946\" data-end=\"3961\">Law 65\/2017<\/strong> on torture, <strong data-start=\"3974\" data-end=\"3999\">military jurisdiction<\/strong> over civilians, and an inactive <strong data-start=\"4032\" data-end=\"4041\">NMIRF<\/strong> since 2021.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"4055\" data-end=\"4093\">Priority recommendations<\/h3>\n<ol data-start=\"4094\" data-end=\"5175\">\n<li data-start=\"4094\" data-end=\"4275\">\n<p data-start=\"4097\" data-end=\"4275\"><strong data-start=\"4097\" data-end=\"4146\">Accountability for conflict-related killings:<\/strong> Support an <strong data-start=\"4158\" data-end=\"4211\">independent international investigative mechanism<\/strong>; reinstate cooperation with international justice mechanisms.<\/p>\n<\/li>\n<li data-start=\"4276\" data-end=\"4458\">\n<p data-start=\"4279\" data-end=\"4458\"><strong data-start=\"4279\" data-end=\"4300\">Custodial deaths:<\/strong> Adopt a <strong data-start=\"4309\" data-end=\"4350\">national death-investigation protocol<\/strong> consistent with the Minnesota Guidelines; guarantee <strong data-start=\"4403\" data-end=\"4432\">unimpeded NHRC-CPT access<\/strong> to all detention sites.<\/p>\n<\/li>\n<li data-start=\"4459\" data-end=\"4655\">\n<p data-start=\"4462\" data-end=\"4655\"><strong data-start=\"4462\" data-end=\"4481\">Justice reform:<\/strong> Amend <strong data-start=\"4488\" data-end=\"4503\">Law 65\/2017<\/strong> (no statutes of limitation; full CAT alignment); adopt the <strong data-start=\"4563\" data-end=\"4588\">judicial independence<\/strong> law; restrict <strong data-start=\"4603\" data-end=\"4622\">military courts<\/strong> to strictly military offenses.<\/p>\n<\/li>\n<li data-start=\"4656\" data-end=\"4820\">\n<p data-start=\"4659\" data-end=\"4820\"><strong data-start=\"4659\" data-end=\"4685\">Medico-legal capacity:<\/strong> Establish an <strong data-start=\"4699\" data-end=\"4742\">Independent National Forensic Institute<\/strong> with standardized procedures, quality assurance, and independent oversight.<\/p>\n<\/li>\n<li data-start=\"4821\" data-end=\"5001\">\n<p data-start=\"4824\" data-end=\"5001\"><strong data-start=\"4824\" data-end=\"4854\">Protection &amp; transparency:<\/strong> Enact <strong data-start=\"4861\" data-end=\"4883\">witness-protection<\/strong> legislation; publish annual statistics on deaths in custody and law-enforcement killings; reactivate the <strong data-start=\"4989\" data-end=\"4998\">NMIRF<\/strong>.<\/p>\n<\/li>\n<li data-start=\"5002\" data-end=\"5175\">\n<p data-start=\"5005\" data-end=\"5175\"><strong data-start=\"5005\" data-end=\"5037\">Socio-economic determinants:<\/strong> Integrate public-health, food-security, disability inclusion, and environmental risk controls into a national <strong data-start=\"5148\" data-end=\"5174\">right-to-life strategy<\/strong>.<\/p>\n<\/li>\n<\/ol>\n<h2 data-start=\"5182\" data-end=\"5210\">The SR\u2019s public programme<\/h2>\n<p data-start=\"5211\" data-end=\"5492\">The Special Rapporteur met Government officials, the judiciary and legislators, international organizations, civil society, academics, medico-legal and forensic specialists, and <strong data-start=\"5396\" data-end=\"5420\">victims and families<\/strong> in <strong data-start=\"5424\" data-end=\"5489\">Beirut, Naqoura, Tyre, Saida, Nabatiyeh, Baalbek, and Tripoli<\/strong>.<\/p>\n<p>The UN Special Rapporteur on extrajudicial, summary or arbitrary executions, Morris Tidball-Binz,\u00a0 expressed during a <strong data-start=\"5495\" data-end=\"5516\">Press conference on<\/strong>\u00a0<strong data-start=\"5517\" data-end=\"5551\">Friday, 10 October 2025, 15:00<\/strong> \u2014 <strong data-start=\"5554\" data-end=\"5608\">United Nations House (ESCWA), <\/strong>his solidarity with survivors and the families of those killed in Lebanon, amid the widespread destruction, loss of life and civilian suffering resulting from hostilities by Israel.<\/p>\n<p>\u201cEvery potentially unlawful death must count, and every family is entitled to truth and justice,\u201d the Special Rapporteur said in a\u00a0<a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/issues\/executions\/sr-sumex\/statements\/20250911-eom-lebanon-sr-summary-executions-en.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">statement<\/a>\u00a0concluding an official visit to Lebanon.<\/p>\n<p>\u201cLebanon has the legal tools to act now and demonstrate that casualties are not mere numbers, they have names,\u201d he said. The expert paid tribute to those who lost their lives in the line of duty, expressing deep admiration and support for journalists, healthcare workers, and others who continued their vital work despite the dangerous circumstances.<\/p>\n<p>\u201cLebanon has the legal tools to act now and demonstrate that casualties are not mere numbers, they have names,\u201d he said. The expert paid tribute to those who lost their lives in the line of duty, expressing deep admiration and support for journalists, healthcare workers, and others who continued their vital work despite the dangerous circumstances.<\/p>\n<p>Tidball-Binz welcomed ongoing legislative efforts to strengthen the independence of the judiciary, and encouraged authorities to report and, where appropriate, prosecute conduct that may amount to international crimes, in accordance with Lebanon\u2019s obligations under international human rights law and, where applicable, international humanitarian law.<\/p>\n<p>\u201cAccountability requires prompt, effective, thorough, independent and impartial investigations and criminal proceedings, which enable access to reparation for victims and their families,\u201d the expert said.<\/p>\n<p>The Special Rapporteur \u2013 who is also forensic doctor \u2013 observed the urgent need to enhance the medico-legal death-investigation capacity in Lebanon, which represents a critical component of any investigation into potentially unlawful deaths, whether arising from suspected suicide, deaths in custody or alleged war crimes.<\/p>\n<p>During his visit, the expert explored the possibility of establishing a national medico-legal institute, with standardised procedures, quality assurance and independent oversight, to ensure competent determination of the cause, manner and circumstances of death.<\/p>\n<p>\u201cBuilding modern forensic capacity, consistent with the Minnesota Protocol on the Investigation of Potentially Unlawful Death (2016), is indispensable to credible investigations,\u201d he said.<\/p>\n<p>Tidball-Binz said investigations must be victim-centred, ensuring meaningful participation of families, protection of witnesses and professionals, and the preservation of evidence and the chain of custody. He also underscored the need for systematic data collection and public reporting on casualties and investigative findings, as well as close coordination among justice, health and security institutions, including with specialised forensic services, to guarantee accountability and transparency.<\/p>\n<p>During his visit, the Special Rapporteur met with government officials, members of the judiciary and prosecution services, security and investigative authorities, medico-legal and health professionals, UN representatives, civil society organisations, academics, and survivors and families of victims in Beirut, Naqoura, Tyre, Saida, Nabatiyeh, Baalbek, and Tripoli.
